- WX03415Y2015T - Justification for Other Than Full and Open Competition WX03415Y2015T - Statement of Work This Notice of Intent is NOT a Request for Proposal (RFP) for competitive proposals; however, in accordance with Part 6.302-1, the Federal Emergency Management Agency (FEMA) intends to award a sole source purchase order according to FAR 13.5, based on the authority of FAR 6.302-1 "only one responsible source and no other supplies or services will satisfy agency requirements". FEMA intends to award a purchase order to National Fire Protection, Inc. to provide preventive and remedial maintenance services for DHS, FEMA, Mt. Weather Emergency Operations Center (MWEOC) fire suppression system equipment. Preventive maintenance services will include specific inspections, testing and certifications, as required for each fire suppression system. Remedial maintenance services are also required for unexpected repairs of malfunctioning equipment. A portion of the work to be performed is located in a classified area that requires a TOP SECRET security clearance to access. An active DSS TOP SECRET facility clearance is required of the Contractor and any Subcontractors; individual TOP SECRET clearances are required for all staff performing work under this contract at the MWEOC facility. This action is being performed in accordance with FAR 6.302-1(b)(1)(i) which states this authority may be used, "When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities...". A Justification for Other Than Full and Open Competition has been approved by the Contracting Officer and is provided as an attachment to this notice. National Fire Protection, Inc. is only known responsible source for providing preventive and remedial maintenance on MWOEC's fire suppression system equipment because they are believed to be the only source in the area that can provide maintenance technicians who have the required TOP SECRET security clearance. National Fire Protection, Inc. is also the only known source with an active DSS TOP SECRET facility clearance. The Statement of Work (SOW) defining the preventive and remedial maintenance services required for MWEOC's fire suppression system equipment is also provided as an attachment to this notice. At this time, National Fire Protection, Inc. is believed to be the only responsible source with an active DSS TOP SECRET facility clearance which is capable of providing certified maintenance technicians with TOP SECRET security clearances to perform these maintenance services. However, any Contractor with an active DSS TOP SECRET facility clearance and TOP SECRET cleared maintenance technicians capable of providing the required preventive and remedial maintenance services as defined in the SOW is asked to contact Phyllis Woodward via email at Phyllis.Woodward@fema.dhs.gov or by fax to 540-542-2631, no later than 4:00 PM Eastern on Monday, September 21, 2015. Please provide your company DUNS number and CAGE Code as well as your capability information. This information will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the Government.
