- FBO ANNOUNCEMENT: PRESOLICITATION NOTICE/ NOTICE OF INTENT TO SOLE SOURCE ACTION CODE: <PRESOL/NOI> CLASSIFICATION CODE: 66 - Laboratory Equipment and Supplies SUBJECT: NOTICE OF INTENT TO SOLE SOURCE SERVICE AND REPAIRS OF PHILIPS GEMINI TF 16-SLICE PET/CT SCANNER SOLICITATION NUMBER: NB682040-16-00372 RESPONSE DATE: November 18, 2015 CONTACT POINTS: Harry Brubaker, Contracts Specialist, 301-975-8330; Paula Wilkison, Contracting Officer, 301-975-8448 DESCRIPTION: The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a Sole Source basis, with PHILIPS HEALTHCARE, A DIVISION OF PENAC OF BOTHELL, WASHINGTON for the service and repair of a Philips Gemini TF 16-slice PET/CT Scanner under other than full and open competition by the authority of FAR subpart 13.106(1)(b). The Philips Gemini TF 16-slice PET-CT scanner system has recently developed an issue with its patient transport system and requires repairs. Because the system cannot operate without this component, all research activities are halted until repairs can be performed. Performing the work will require access to the Philips software components of the scanner system that are proprietary to the manufacturer. The software license agreement for these components prohibits access to them by anyone other than NIST or Philips employees. Because the system cannot be diagnosed (prior to repair) or re-calibrated (post-repair) without access to the software, this work can only be performed by a Philips service engineer. Therefore, only one source (Philips) is qualified to work on this equipment. PHILIPS HEALTHCARE does not have authorized third parties to service its equipment. This requirement is expected to be awarded in December, 2015. The North American Industry Classification System (NAICS) code for this acquisition is 811219- Other Electronic and Precision Equipment Repair and Maintenance and the size standard is $20,500,000. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 4:00 PM EST (Noon) on Wednesday November 18, 2015. Inquiries will only be accepted via email to Harry.Brubaker@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
