Description
The Army Contracting Command - Aberdeen Proving Ground on behalf of the Defense Biological Product Assurance Office (DBPAO) intends to award a contract modification extending the current contract for two (2) twelve (12) month options on a sole source basis with BBI Research Inc. for the manufacture of Lateral Flow Immunoassay (LFI) strips. The Bio-defense detection LFI assays support DoD operational needs in detecting Biological Warfare Agents (BWAs) and are in operation 24 hours a day, seven days a week detecting life-threatening biological agents. The continued manufacturing of these LFI assays are vital in preserving not only Homeland Security efforts but Joint Services BWA detection capability abroad. The current contractor, BBI Research Inc., is the only company that has an inventory of the government furnished antibodies and antigens necessary to manufacture these LFI assays. In addition BBI Research has successfully performed First Article Testing (FAT) using these materials that show they can manufacture these LFI assays in accordance with the DBPAO performance criteria. In September 2015, the Secretary of the Army issued an immediate safety review and an extension of the moratorium already instituted at Dugway Proving Ground (DPG) to now to include all DoD laboratories/facilities and materials associated with DBPAO. The moratorium halts the production, shipment, and handling of any live or inactivated Biological Select Agents and Toxins (BSAT), or derivatives of BSAT. Since BBI Research Inc. is a DBPAO performer, they fall under the auspices of the moratorium. Exclusions to the moratorium allowed for the shipping of LFI assays. This was further expanded to allow BBI Research Inc. to utilize government furnished inactivated materials already in inventory in order to continue to manufacture these vital LFI assays. The exclusions did not extend to the shipping of antigenic material. With the indefinite closure of DPG and extension of moratorium, which is anticipated to be lengthy, and no other readily available way to provide continued supply of inactivated materials to manufacture LFI strips, two (2) twelve (12) month options will allow for continuity of LFI supply if necessary. Due to the safety review and an extension of the moratorium, the intended contractor BBI Research Inc., 2312 Vondron Road, Madison, WI 53718. BBI Research Inc., is the only responsible source at this time capable of providing LFI strips required in that it possesses the only qualified government furnished material accessible to manufacture LFI strips. The DBPAO will assess other courses of action should the moratorium be lifted or modified. A Firm Fixed Price Indefinite Delivery, Indefinite Quantity type contract modification will be awarded. The statutory authority permitting acquisition of these items by other than full and open competition is 10 U.S.C.2304(c)(2), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This is not a request for competitive proposals. Parties purporting to have the means to obtain the required government materials needed to manufacture from BBI Research Inc., in light of the moratorium, without unacceptable delays in fulfilling the agency's requirements must furnish, in writing, factual information which clearly supports and demonstrates that they are able to obtain the necessary materials and produce the required LFI assays, This information shall be provided no later than November 18, 2015.
