- The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the Center for Nanoscale Science and Technology (CNST), intends to negotiate on a sole source basis with Design Workshop Technologies, Inc, Pointe-Claire Canada, under the authority of FAR Subpart 13.106-1 (b), Soliciting from a Single Source. The Center for Nanoscale Science and Technology (CNST) NanoFab currently has four seats on two network floating licenses for dw2000 software, serial numbers 20114246 & 20114247. The CNST requires renewal of these software maintenance and support licenses. The dw2000 layout editor software is currently in use by the scientists and technical staff in the CNST. This software is used for microelectronics layouts, and is also used in fields such as mask-making, electro-optics, photonics, thin film heads, sensors, flat panel displays, CCD, medical imagery, and power conversion. Renewal of yearly maintenance is needed for continued access to technical support and product upgrades and is vital to the support of NIST programs. In addition, The CNST NanoFab Facility has "remote users" who work with staff of the facility to complete projects. These users do not physically visit the NanoFab facility, instead the work is done by staff of the NanoFab facility. The user and staff collaborate by exchanging files before actually implementing the design using the equipment. If we were to switch to another software, we would lose capability to collaborate as effectively and could result in decrease in user base for the NanoFab facility. The only source of supply for this software and yearly maintenance support is Design Workshop Technologies, Inc. Therefore, the vendor is uniquely qualified to fulfill the Governments requirements as they have no authorized resellers for their products. The NAICS Code is 511210 with a size standard of $38.5M. NIST anticipates negotiating and awarding a firm-fixed-price purchase order to include 3 option years, for this requirement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by established date and time. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
