Description
NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source basis with North Carolina Department of Environmental Quality, Raleigh, North Carolina, using the procedures in FAR Part 13, to cover survey expenses of the 2016-2018 North Carolina Census Catch Card Program and Biological Sampling. The National Marine Fisheries Service (NMFS) currently has a rule that requires mandatory reporting of all recreationally landed blue marlin, white marlin, sailfish, Atlantic Bluefin tuna, and swordfish. Catch card census programs satisfy the NMFS mandatory reporting rule and provide supplemental catch information. A large pelagics catch card program has been conducted by the North Carolina Department of Environmental Quality (NCDEQ) (formally North Carolina Division of Marine Fisheries) since 1998 with funding and technical support from NMFS. The NCDEQ catch card program requires mandatory reporting of certain recreationally landed highly migratory species. Captains or operators of permitted vessels will be required to complete a catch card to be submitted at a reporting station in exchange for a landings tag. A catch card must be submitted for each individual fish landed. Catch cards will be widely available at marinas, state marine resource agencies, large pelagic species tournaments, and other sources. The NCDEQ has been chosen for this project for the following reasons: This project requires mandatory reporting of Bluefin tuna and billfish landings by boat captains. As the only regulatory agency authorized to change and enforce the State of North Carolina's fishery management regulations, NCDEQ is uniquely qualified to enable NMFS to accomplish the goals of this contract. The success of this project relies greatly on agency outreach efforts aimed at informing and educating captains about the mandatory reporting requirement and how best to meet this requirement. As the state's fishery management agency NCDEQ is uniquely qualified to get this message across through their web page, agency issued literature, personal communications, and other means of agency communication. NMFS and NCDEQ have formed a partnership to successfully conduct this project every year since 1998. Continuing this partnership will greatly enhance the quality of the data collected. In additional NCDEQ is a state agency and 16 U.S.C. 1881(d) justifies sole-source contracts specifically to state agencies. The statutory authority for other than full and open competition is FAR 13.106-1(b), only one responsible source. The North American Industry Classification Code (NAICS) for this acquisition is 541620 with a business size standard of $15.0 million. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A statement of capabilities must be received by 4:00 PM, December 31, 2015. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
