Sources Sought Document Sources Sought Notice I. INTRODUCTION This Sources Sought Notice is issued solely for informational and planning purposes and does not constitute an Invitation for Bids, Request for Proposal, or Request for Quotations. In accordance with FAR 15.201(e), responses to this notice are not offers and cannot be accepted by the Government to form a binding contract, nor do they affect a potential offeror's ability to respond to any future synopsis/solicitation which may or may not follow or restrict the U.S. Government's eventual acquisition approach. Additionally, the U.S. Government will not provide reimbursement for any information that may be submitted in response to this notice. Respondents are solely responsible for all expenses associated with responding to this notice. Interested vendors responding to this sources sought may provide capability information for all pieces of this requirement or for an entire solution. Respondents will not be notified of any results derived from a review of the information provided; however information gathered may be utilized for technical and acquisition purposes. Time permitting and depending upon the information received individual vendors may be contacted for product demonstration. The U.S. Government will not pay for any costs associated with such demonstration(s) of any software products. Please be sure to indicate if you have a GSA schedule contract, a contract on GSA 8(a) STARS, or a contract on GSA VETS GWAC. II. BACKGROUND The ACL/OEJAPS is conducting a market survey for the creation of a national legal assistance support system that provides comprehensive resource support to legal and aging providers and advocates on a broad range of legal issues and systems development issues. ACL legal assistance and elder rights programs funded under the OAA have a long history of empowering older adults to remain independent, healthy, and financially secure within their homes and communities. Legal programs are a priority service under the OAA and are essential in assisting older adults address a wide range of challenges involving income security, housing, health care, consumer protection, guardianship, elder abuse/neglect, and financial exploitation. Legal assistance and elder rights programs also work in close conjunction with other core ACL programs and services designed to maximize the independence of older adults in home and community based settings. Programs funded under Title IV, Section 420(a)(1), are intended to create a national legal assistance support system for aging and legal service providers and advocates. This function has been previously served by the National Legal Resource Center (NLRC) from 2008 to 2015. Representing a bold evolution of the NLRC, a newly contemplated National Center on Law and Elder Rights (NCLER) will empower professionals in aging and legal networks with the tools and resources necessary to provide older clients and consumers with high quality legal assistance in areas of critical importance to their independence, health, and financial security. Through this RFI, ACL/OEJAPS is seeking information as to available products and services in order to create a comprehensive national legal assistance support system for aging and legal service providers and advocates. Specifically, ACL/OEJAPS seeks a solution that provides unified and comprehensive resource support through a strategic combination of case consultation, training, and technical assistance on a broad range of legal issues and systems development issues. The solutions should be responsive to the statutory provisions under Title IV, Section 420 of the OAA as follows: a) PROGRAM AUTHORIZED.-The Assistant Secretary shall make grants and enter into contracts, in order to- (1) provide a national legal assistance support system of activities to State and area agencies on aging for providing, developing, or supporting legal assistance for older individuals, including- (A) case consultations; (B) training; (C) provision of substantive legal advice and assistance; and (D) assistance in the design, implementation, and administration of legal assistance delivery systems to local providers of legal assistance for older individuals; and (2) support demonstration projects to expand or improve the delivery of legal assistance to older individuals with social or economic needs. (b) ASSURANCES.-Any grants or contracts made under subsection (a)(2) shall contain assurances that the requirements of section 307(a)(11) are met. (c) ASSISTANCE.-To carry out subsection (a)(1), the Assistant Secretary shall make grants to or enter into contracts with national nonprofit organizations experienced in providing support and technical assistance on a nationwide basis to States, area agencies on aging, legal assistance providers, ombudsmen, elder abuse prevention programs, and other organizations interested in the legal rights of older individuals III. OBJECTIVE The objective for this RFI is to gather industry information on the best solutions for generating, disseminating, and applying knowledge and expertise intended to improve the quality, efficiency, and effectiveness of state and local programs that provide legal assistance and elder rights protections to older adults in the most social or economic need. The national legal assistance support system should demonstrate the ability, capability, and capacity to: • Provide a centralized point of entry into a national legal assistance support system that will provide high quality legal training on complex legal issues; • Provide a centralized point of entry into a national legal assistance support system that will provide high quality legal case consultation and expert advice on complex legal issues; • Support the leadership, knowledge, and delivery systems capacity of states, legal services providers, AAAs, ADRCs, elder abuse prevention personnel, in order to enhance the quality, cost effectiveness, and accessibility of legal assistance and elder rights programs provided to older persons in the most social or economic need; • Support statewide legal assistance development programs under Title VII of the OAA; • Support demonstration projects designed to expand or improve the delivery of legal assistance and elder rights protections to older persons with social or economic needs; • Promote and support legal service delivery systems that are able to identify, prevent, and respond to legal issues that emerge from elder abuse; • Promote and support the development of data collection systems and outcome measures for legal and elder rights programs; IV. TECHNICAL REQUIREMENTS In order to respond to this notice, prospective offerors must be able to clearly convey its experience and/or ability to perform the following tasks identified: a. Provide Legal Training for legal and aging networks on issues related to:  Elder abuse prevention and supported decision making;  Income security and the financing of healthcare and long-term services and supports (LTSS) in all care settings; and  Consumer protection and housing security/accessibility b. Provide Case Consultation for legal and aging networks on issues related to:  Elder abuse prevention and supported decision making;  Income security and the financing of healthcare and long-term services and support (LTSS) in all care settings; and  Consumer protection and housing security and accessibility c. Provide Technical Assistance on Legal Assistance Development issues related to:  Needs assessment tools designed to identify priority legal issues impacting target populations;  Systems capacity assessment tools designed to identify the ability of existing legal systems to address priority legal issues impacting target populations;  Integration of Senior Legal Helplines into the broader Title III-B legal services and elder rights networks;  Integration of low-cost service delivery mechanisms, such as pro bono volunteer attorney services, law school clinics, and self-help sites with the broader Title III-B legal services network;  Targeting and outreach strategies to direct legal services to populations that are the hardest to reach and most in need;  Legal service delivery standards focusing on the quality, consistency, and efficiency of legal service delivery systems;  Integration of legal assistance and elder rights protection programs for older adults into existing home and community based aging/disability service delivery systems; and  Guardianship over the elderly, including legal representation of alleged incapacitated persons, use of less restrictive alternatives, use of limited guardianship, oversight of court appointed guardians, guardianship mediation; and implementation of supported decision-making models to avoid guardianship. d. Provide Technical Assistance on Legal Data Collection and Reporting Systems on issues related to:  Role of the LAD in leading the creation of the legal data collection/reporting system;  Identifying individuals with the necessary knowledge and expertise to be involved in the development and implementation process;  Identifying and/or estimating the resources necessary to develop a legal data collection/reporting system;  Anticipating challenges in the development and implementation of the legal data collection/reporting system; and  Coordinate development efforts with national initiatives developing legal data collection and reporting guidelines. INSTRUCTIONS FOR RESPONDING TO RFI Information provided in response to this RFI must be submitted electronically to the Contract Specialist no later than twenty-five (25) calendar days from the date of posting, in the form of a "white paper." Responses should be limited to not more than fifty (50) single spaced pages exclusive of marketing slicks or published information available at time of release of the RFI request. We request electronic responses only. E-mail a copy of all response files to Contract Specialist at: David.Morgan@psc.hhs.gov. Response to this RFI should include A Statement of Qualifications/Capabilities Statement package as the cover letter. The cover letter must cite the following information at a minimum: 1. Response to RFI Number; 2. Vendor's Organization/Company Name, Address, Contact Person Information; 3. Vendor's DUNS Number; 4. Business Size and Size Standard / Classification We ask that the capability statement not exceed 10 single sided pages in length. Please identify your size classification relative to North American Industry Classification System (NAICS) code of 541512 "Computer Systems Design Services" for this requirement. Include whether or not you are a small business; HUBZone small business; service-disabled, veteran-owned small businesses; 8(a) small business; women-owned small business; or small disadvantaged business in order to assist the government in determining the appropriate acquisition method, including whether a set-aside is possible. Please note that the collection of this data does not obligate the U.S. Government to the incorporation of the solicited comments in any future procurement action nor does it obligate the Government to the procurement of any services or products related to this RFI. Proprietary information should not be included in the RFI response. Responses to this RFI will not be returned. Interested parties shall provide the following information in their white paper responding to this RFI: 1. Full or Partial Solution and/or Alternative Solutions - What is the respondent's approach(es) to the requirements stated above? Respondents shall formulate their responses as a requirement-by-requirement analysis, with "Not Available" stated clearly next to any requirements their solutions do not meet. 2. Nature of the Solution - What approach or mix of approaches (e.g., products, tools, processes, and services) does the respondent believe most appropriate for providing the capability that ACL/OEJAPS is requesting. Describe preference and options for implementation, whether integrated within ABC Office or deployed as separate (e.g.: cloud-based) solution with communications to/from EPIC. Describe whether any components of the solution are open source. 3. Vendor Experience - Please describe the vendor's experience implementing the solution described above. In addition to the vendor's experience implementing the solution described above, please describe results that customers have obtained in terms of the vulnerabilities that have been discovered and remedied. Vendors should provide references for at least two production clients operating for a minimum of 18 months. All respondents should include source code control and application life cycle management requirements or practices. 4. Related Services - Describe project management, configuration support, release management, system integration and implementation, helpdesk and other support services in connection with this offering.
