Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION In accordance with the authority granted under FAR Pait 13, this request for a noncompetitive acquisition is hereby submitted for consideration for acquisition approval. 1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY: Requesting Agency: USDA, APHIS, PPQ, MEXFF Rearing Facility, Bldg. 6418 22675 N Moorefield Road Edinburg, TX 78541 Contmcting Activity: USDA, APHIS, MRPBS, ASD Minneapolis Procurement Branch Butler Square, Fifth Floor 100 North 6111 Street Minneapolis, MN 55403 2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED: Due to the circumstances described below, the APHIS, Plant Protection and Quarantine (PPQ), Mexican Fruit Fly Rearing Facility (MFFRF) request the following be acquired using a noncompetitive procurement in support of program mission requirements. 3. A DESCRIPTION OF THE SUPPLIES, EQUIPMENT, OR SERVICES REQUIRED TO MEET AGENCY NEEDS (INCLUDING THE ESTIMATED VALUE OF THE ACQUISITION INCLUSIVE OF OPTIONS): This material is used on two sides of each of our fifty (50) colony cages that hold fe1tile male and female Mexican Fruit flies, Anastrepha ludens where mating occurs. After insemination, the fertile females deposit fertile egg masses using her ovipositor that penetrates the material and deposits eggs that are harvested seven days per week. The material mimics the skin of a citrus fruit in thickness, flexibility, and texture to the mass reared flies. The harvested eggs are incubated for four days and then prepared for infestation on mtificial diet. This specific material has been successfully used for years and has proven of the perfect thickness, flexibility, and texture that the females accept and will readily deposit egg masses. The expected life of the material, once installed in a colony cage, is approximately 9 months. In addition, this material can be easily sanitized by traditional means and does not provide an enviromnent for nematode and microscopic worms to thrive which the absence of these entities is critical for the mass production of good quality eggs and flies. The acquisition of this specific material is very important and critical for the functionality and continuity of operations for our program and facility. Since this material is made to order and has been tested and proven by our scientist on its functionality as an egg laying material for the fruit fly, it will be difficult for this material to be a competitive acquisition. The last purchase was on 3/31/2009 (order number AG-6395 -P-09-0680 - see attachment at end of justification). The current estimated value per yard of this material is $20.26. This facility will need approximately 1000 yrds for a total cost of $20,260.00. The estimate is based on quote from the vendor (see attachment at end of justification). 4. IDENTIFICATION OF THE STATUATORY AUTHORITY PERMITTING NONCOMPETITIVE ACQUISITIONS: Company provided a descriptive construction which states that the material needed was developed in their laboratories (See specification sheet at end of justification). 5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED: The work unit is not aware of any other company that produces this specific material. Since this material is made to order and has been tested and proven by our scientist on its functionality as an egg laying material for the fruit fly, it will be difficult for this material to be a competitive acquisition. 6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS, OR WILL BE, PUBLICIZED AS REQUIRED BY FEDERAL ACQUISITION REGULATION (FAR) SUBPART 5.2, AND IF NOT, WHICH EXCEPTION UNDER FAR 5.202 APPLIES: (This is ajoint effort that requires collaboration between the program manager and the contracting activity) Document and take creditfor all efforts to seek additional sources. 7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE, AND THE BASIS FORTHAT DETERMINATION: I have determined the anticipated cost to the government is fair and reasonable, based on the past requirement and discussions had with the program. 8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (FAR PART 10) AND THE RESULTS, OR AN EXPLANATION OF THE REASON MARKET RESEARCH WAS NOT PERFORMED: This section shall be completed by the procuring official. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION - FAR 6.303-2(a)(9): This section may be used to add factual information to clarify, expand upon, or defend the unique qualifications, character, or nature of the proposed contractor, or the supplies, equipment, or services to be acquired as cited in No. 4 above. 10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITON: Someone has contacted a program representative or the contracting activity in the past about this effort, project, item, or service. 11. A STATEMENT OF THE ACTIONS, IF ANY. THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES, EQUIPMENT, OR SERVICES REQUIRED: (This is a joint effort that requires collaboration between the program manager and the contracting activity) 12.
