- U.S. General Services Administration GSA Region 7 Leasing Division Justification for Other than Full and Open Competition Lease Number: TBD Project Number: 0TX2368 Agency Name : Dept. of Justice (DOJ) and Federal Trade Commission (FTC) Identification and Description of Action Being Approved: The General Services Administration currently leases 49,446 rentable square feet (RSF)/ (43,765 ANSI/BOMA Office Area square feet) of office space at <img src="file:///C:/Users/Sara-JalynSutherland/Desktop/11116/JOTFOC%20Electronic%20Signature%20Page_Redacted/Image_001.png" alt="image" width="123" height="14" /> Dallas, Texas under lease number GS-LTX15307 for the DOJ and FTC. The current lease expires 3/6/2018. Approval is requested to negotiate a succeeding lease for these 2 agencies with the incumbent lessor without full and open competition for continued occupancy at this lease location. Description of Supplies or Services Required: DOJ and FTC submitted written documentation for 13,986 RSF (12,379 ANSI/BOMA Office Area square feet) of office and related space. These agencies are currently occupying space under a lease that also includes the Government Accounting Office (GAO). This request for other than full and open competition is only for DOJ and FTC. Any new action for GAO will be handled under a separate project. This requirement is for 13,986 RSF (12,379 ANSI/BOMA Office Area square feet) of space for a 10-year term to commence on or about 7/6/2015. The estimated annual cost of this lease is <img src="file:///C:/Users/Sara-JalynSutherland/Desktop/11116/JOTFOC%20Electronic%20Signature%20Page_Redacted/Image_002.png" alt="image" width="132" height="14" /> per RSF), with a total contract value of <img src="file:///C:/Users/Sara-JalynSutherland/Desktop/11116/JOTFOC%20Electronic%20Signature%20Page_Redacted/Image_003.png" alt="image" width="92" height="14" />. The delineated area is as follows: North: Beginning at the intersection of I-35E and Woodall Rogers Freeway, traveling eastward to the intersection of Woodall Rogers Freeway and Hwy 75; East: Beginning at the intersection of Woodall Rogers Freeway and Hwy 75 then southward to the intersection of Hwy 75 and I-30 (East R.L. Thornton Freeway); South: Beginning at the intersection of Hwy 75 and I-30 (East R.L. Thornton Freeway) then westward to the intersection of I-30 (East R.L. Thornton Freeway) and I-35E; West: Beginning at the intersection of I-30 (East R.L. Thornton Freeway) and I-35E then northward back to the intersection of I-35E and Woodall Rogers Freeway Identification of Statutory Authority: 41 U.S.C. 253(c) (1): Only one responsible source and no other supplies or services will satisfy agency requirements Demonstration that the Acquisition Requires use of the Authority Cited: GSAM 570.402-5 allows for negotiation with the incumbent lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition. GSA placed an advertisement conforming to GSAM 570.402-2 on the Federal Business Opportunities Web site ( fedbizopps.gov ) on February 25, 2014 and received no responses. Award to other than the current Lessor would require relocation of the entire requirement and would cause DOJ and FTC to incur move and replication costs that would not be recovered through competition. The respective amount of RSF for each agency is: DOJ 5,061 and FTC 8,925.
