- JUSTIFICATION FOR NON-COMPETITIVE PROCUREMENT for Morse Creek Acclimation and Rearing Ponds Facility for Elwha River Ecosystem Restoration Olympic National Park OVERVIEW In 1992 the Elwha River Ecosystem and Fisheries Restoration Act (Elwha Act) became law. The Elwha Act authorizes the Secretary of the Interior to remove the Elwha and Glines Canyon dams on the Elwha River Washington "to fully restore the Elwha River ecosystem and native anadromous fisheries." Since passage of the Elwha Act, Puget Sound Chinook salmon, including chinook in the Elwha River, was listed as endangered pursuant to the Endangered Species Act. The Washington Department of Fish and Wildlife (WDFW), raises Elwha River Chinook salmon in the Elwha River Rearing Channel. Both naturally spawning and artificially reared Elwha River chinook are listed. Removal of the two dams resulted in the release of large quantities of sediment that had accumulated in the reservoirs created by the two dams. Release of this sediment put the listed chinook salmon at risk, even though the water quality of the Elwha Rearing Channel was protected. Consequently and in agreement with WDFW and NOAA Fisheries, a portion of the chinook production from the Elwha Rearing Channel was temporarily relocated to Morse Creek, a nearby stream that was unaffected by dam removal. Removal of the two dams was completed in 2014. Chinook salmon have been transferred to Morse Creek beginning in 2010 to ensure that each returning year class of fish is protected. NPS contracted with WDFW in 2010 to operate the Morse Creek Facility (MCF) to protect the Elwha Chinook salmon. Dam removal has completed without incident, and rearing of new salmon at MCF is no longer needed. However, the return of the salmon as adults to Morse Creek will continue until 2020, thus the holding ponds must be maintained and operated until 2020. Chinook will return to Morse Creek as 2-, 3-, 4-, or 5-year old fish. AUTHORITY Federal Acquisition Regulation s Subpart 6.3 provides for circumstances permitting other than full and open competition. In this procurement, Subpart 6.302-1 (a) (2) (i) is hereby incorporated into this justification; "Supplies or services may be considered to be available from only once source." The requirement is met under paragraph 6.302-1 (b) (1) (i): "Unique supplies or services available from only one source or only one supplier with unique capabilities." JUSTIFICATION 6.303.2 (a)(1) Identification of Agency National Park Service, Dept. of Interior Olympic National Park (a)(2) Nature or Description of Action Being Approved. Contract with the Washington Department of Fish and Wildlife (WDFW) for operations and maintenance of the WDFW owned and operated Morse Creek Acclimation and Rearing Ponds Facility (MCF), including recovery of adult salmon in the proposed award amount of $360,583.00. The sole purpose of the facility is to meet the scientific Biological Opinion rendered during project initiation of the Elwha River Restoration. The site is owned and operated by WDFW and once the Elwha River Restoration is completed, the facility will be removed from service. (a)(3) Description of supplies or services required As described in (a) (2) above. Juvenile chinook salmon have been moved to the MCF, placed into prepared ponds for short-term rearing, and released into Morse Creek, and will continue to be recovered as adults at a constructed weir in Morse Creek, gametes collected and taken to the Sol Duc Fish Hatchery for incubation and early rearing. The program will be monitored to determine success and need for modification of the program as necessary. (a)(4) Identification of Authorities permitting other than full and open competition Subpart 6.302-1 (a) (2) (i) is hereby incorporated into this justification; "Supplies or services may be considered to be available from only once source." (a)(5) Demonstration that proposed contractor's unique qualifications or nature of the Acquisition requires the use of the authority cited. The WDFW possesses the needed fish and is obligated by NOAA Fisheries to maintain the population. WDFD Morse Creek Facility is owned by the State of Washington and operated through the States Department of Fish and Wildlife. WDFW gained the expert knowledge and experience in raising and transporting Elwha River Chinook salmon since the Elwha Rearing Channel operation began in 1975. WDFW also has the necessary staff required to ensure engineering and fish health expertise and respond to any contingency in the Morse Creek Program. WDFW is willing and able to comply with the needs of this program. (a)(6) Description of efforts made to ensure that offers are solicited from as many potential sources as is practical, including whether a CBD notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. Not Applicable (a)(7) Contracting Officer's determination that cost is fair and reasonable. The NPS Elwha Project Team, in consultation with NOAA Fisheries, has reviewed the program and made the recommendation to the CO that the cost estimates are fair and reasonable. This review is based on the concept that the WDFW MCF is solely operated for the purpose of this contract on state owned and controlled land. The WDFD operates the MCF with professional personnel specifically trained to handle endangered species IAW applicable laws and restrictions. The WDFW is a not for profit entity in that the WDFW contracts for actual anticipated costs to operate the facility. The Contracting Officer agrees with the review and considers the proposed costs from WDFW to be fair and reasonable. (a)(8) Description of market survey conducted. Market Survey was not conducted due to the nature of the effort required. No other contractor would be permitted to collect endangered species like the WDFW. Further, the WDFW owns and operates the facility and even if permitted, the contractor would have to rent out facilities, subsequently passing additional costs on to the Government. (a)(9) Other facts supporting use of other than full and open competition. As obligated by NOAA Fisheries and the agreement between the WDFW and area Tribes, the WDFW is the only one of two entities that has the legal authority to raise Elwha River Chinook salmon. The other is the Elwha Tribe on tribal lands. (a)(10) Listing of sources expressing an interest in the acquisition. NONE, No opportunity was presented to industry due to the nature of the required effort and the restrictions in dealing with endangered species. (a)(11) Statement of actions, if any, the agency may take to remove barriers to competition. Not undertaken due to requirements. (a)(12) Contracting Officer Certification that justification is accurate.
