Solicitation Document Redacted version of the Justification for Other than Full and Open Competition THE PUPOSE OF THIS AMENDMENT 1 IS TO POST THE J&A AND SOLICITATION DOCUMENT FOR THIS SOLE SOURCE REQUIREMENT THROUGH MARCH 16, 2016, 10:00AM MT. National Institute of Standards and Technology (NIST) Acquisition Management Division Sources Sought for Commercial Item Purchase THIS SOURCES SOUGHT IS NOT A REQUEST FOR PROPOSAL. It is a market research tool being used to determine potential and eligible business firms that are capable of providing the services described herein prior to determining the method of acquisition. The National Institute of Standards & Technology (NIST) seeks information on vendors that are capable of providing a Maintenance and Support on a NIST owned JDSU LTE RAN Load Tester. This announcement is not a Request for Quotation (RFQ) and does not commit the Government to award a contract now or in the future. No solicitation is available at this time. Additionally, The Government is not obligated to and will not pay for any information received from potential sources as a result of this sources sought announcement. The results of this Sources Sought will be utilized to determine if any Small Business Set-aside opportunities exist. All Small Business Set-aside categories will be considered. In addition, this market research tool is being used to identify potential and eligible firms, of all sizes, prior to determining the method of acquisition and issuance of a solicitation. As a result of this Sources Sought announcement, NIST shall conduct a competitive procurement and subsequently award a contract. If at least two qualified small businesses are identified during this market research stage that can fulfil the requirement, in accordance with the requirement descriptions and technical specifications indicated below, then this acquisition shall be solicited as a small business set aside. However, NIST is seeking responses from all responsible sources, including large and small businesses (SB, SDB, WOSB, HUBZone, SDVOSB and VOSB). This requirement is assigned a NAICS code of 811211 Consumer Electronics Repair and Maintenance with a small business size standard of $7.5M. The specific purpose of this Sources Sought Announcement is to determine if there are small businesses, within the parameters identified above, that are capable of providing the equipment identified. Interested business organizations that believe they are capable of meeting the requirement should submit electronic copies of their capability statement. Please limit responses to five (5) pages or less. Responses should include the following information: 1. Name and DUNS Number of company that shall provide product. 2. Name of company that shall perform maintenance and support of the product. 3. Business size status and any socio-economic certifications your business carries. 4. Certification to perform maintenance and support of the product and examples of performance of maintenance and support on JDSU equipment. 5. Typical response time to perform maintenance and support after notification by the product owner. 6. Warranties offered for this type of service performed on the item? 7. Any other relevant information that is not listed above which the Government should consider in developing its minimum specifications and finalizing its market research. DRAFT REQUIREMENTS OVERVIEW: BACKGROUND: The National Institute of Standards and Technology's Public Safety Communications Research Division (PSCR) operates The LTE Radio Access Network (RAN) load tester supporting the Public Safety Broadband Project and the First Responder Network Authority. This critical infrastructure support tool facilitates analysis of the performance and operations of our vendor Enhanced Node B equipment under load in order to evaluate Quality of Service, Priority and Preemption as needed by public safety users. The RAN load tester has the capability to simulate multiple pieces of User Equipment (UEs) and connect to the RF interface of the eNodeB. The simulated UEs under computer control are used to provide loading of the eNodeB to provide simulation of public safety events and assist in analysis of eNodeB performance. PURPOSE: The Government is collecting information for maintenance and support of the equipment procured by JDSU in FY14 and FY15. The maintenance shall be provided for a period of three years beginning January 31, 2016. Description of the support is contained in the JDSU document "Support-Services-Standard-8x5 2015-04.pdf". Hardware support which is listed as optional in the JDSU document shall be included. The Contractor shall accomplish work and support according to manufacturer's specifications. Maintenance and software support shall be accomplished by trained personnel who are fluent in the operation of the covered equipment. In the event that a part or the equipment needs to be repaired off-site, the Contractor shall be responsible for all packaging, shipping and transportation costs as well as liability for the shipment from and to NIST Boulder, CO. All parts and software shall be approved for use with the instrument by JDSU. The Contractor shall only employ tools, instruments, software, test apparatus, methodologies, techniques, and practices approved for use with the instrument by the manufacturer. The service protocols and instrument specifications shall be adhered to at all times. TASKS: Preventive Maintenance Provide preventive maintenance as required by manufacturer's specifications. Preventative maintenance shall include routine maintenance actions recommend by the Original Equipment Manufacturer (OEM) to ensure optimum instrument performance. Preventative maintenance shall ensure the instrument is operating to OEM's specifications and shall take action necessary to ensure optimum instrument operation until the next scheduled visit. Scheduling of the visits shall be consistent with the maintenance requirements of the instrument as detailed in the service and user manuals for the equipment Preventive maintenance visits shall occur during NIST's regular business hours Monday through Friday, between 8:30 a.m. and 5:00 p.m. Mountain Time with the exception of Federal Holidays and shall be scheduled at least 30 days in advance with the NIST Technical Point of Contact (TPOC) or Contracting Officer's Representative (COR). The scheduled maintenance visits shall be made at the same time as an unscheduled visit for corrective or other action if such a visit occurs within one month before a scheduled preventive maintenance visit. System Enhancements Install, or if NIST technical personnel can install the upgrades without compromising system performance than make available for installation, all software upgrades for the purposes of instrument optimization not later than 60 days after any such upgrade is released. If contractor installation is necessary to ensure proper performance, prior to completion of the installation, the Contractor shall test the equipment, review the equipment's performance, and take whatever steps are necessary to ensure the equipment is functioning in accordance with the manufacturers' specifications. Service Calls Respond to an unlimited number of requests for service calls in the event of instrument failure which requires immediate repair. The contractor shall provide travel, labor, and any factory-certified parts that require replacement. Respond to service calls during regular business hours only - Monday through Friday, between 8:30 a.m. and 5:00 p.m. Mountain Time with the exception of Federal Holidays. A service technician shall provide on-site service at NIST Boulder, CO within a maximum of a 72-hour response time after the call is placed. No weekend service visits shall be required. In the event that the Contractor is unable to resolve the problem during the service call, the Contractor shall provide telephone support and on-site support as needed to expedite a solution for NIST. The Contractor is responsible to obtain all parts required for all repairs and maintenance. The Contractor shall make a reasonable effort to secure parts within 24 hours after identifying the need for a replacement part for the covered equipment. All repairs shall result in the instruments meeting manufacturer's specifications. Any parts or components removed for replacement shall become the property of the Contractor unless otherwise agreed to by the parties. The Contractor shall remove the parts from the NIST campus at the time of the service call, or provide shipping instructions and return shipping information that NIST shall return the parts to the Contractor within 3 days after the service visit is completed. The Contractor shall assume all charges and liability for all shipments. Clarification: Should a part need to be replaced and that part is determined to be contaminated, NIST will dispose of the item and the contractor shall order a replacement at US list price. No core rebates will be provided for items deemed to be contaminated. Service Conditions All service provided under this agreement shall be provided by trained personnel who are fluent in the operation of the covered equipment. Service shall be rendered on-site at the NIST Boulder, CO campus unless otherwise agreed by the parties. In the event that a part needs to be repaired off-site, the Contractor shall be responsible for all packaging, shipping and transportation costs as well as liability for the shipment to and from NIST Boulder, CO. The Contractor shall be responsible for providing a "Return Authorization Number" or other information authorizing return of the shipment to their facility prior to the shipment. All parts shall be approved for use with the instrument by Rohde & Schwarz. The Contractor shall only employ tools, instruments, software, test apparatus, methodologies, techniques, and practices approved for use with the instrument by the manufacturer. The service protocols and instrument specifications shall be adhered to at all times. Training Include at least 2 hours of training at NIST for up to 2 NIST personnel covering normal operation, troubleshooting, and routine maintenance. Training shall be provided during normal business hours, between 8:30am and 5:00pm Mountain Time, Monday through Friday, except Federal Holidays, and shall be coordinated with the NIST Technical Point of Contact (TPOC) to ensure maximum availability of NIST personnel. Training is to occur within 10 days of installation. The training shall be completed on-site at NIST immediately after installation and demonstration of specifications. Telephone Support Provide telephone support for the covered equipment during regular business hours. Telephone support shall include response to questions about operating practices, application use, and service issues that can be diagnosed and resolved over the telephone. Warranty The Contractor shall provide, at a minimum, a one-year warranty for any equipment serviced and software acquired. The warranty shall cover all software, parts, labor and travel. The warranty shall commence upon successful completion of delivery, installation, training and demonstration of all required specifications. The Contractor shall provide all information necessary for the COR or TPOC to authorize entrance to the NIST campus in accordance with NIST Security Policy and Procedures. PERIOD OF PERFORMANCE Repair and recertification: From award to 30 days after award. Service and Maintenance: Period of Performance: shall be for three (3) one-year-options. PLACE OF PERFORMANCE Performance shall be at NIST, 325 Broadway St, Boulder, CO 80305, except when mutually agreed upon by both parties. Normal business hours are Monday through Friday, 8:30 a.m. to 5:00 p.m. with the exception of Federal holidays. GOVERNMENT FURNISHED PROPERTY All property, data and information provided by the Government in the performance of this task remains the property of the Government and shall be surrendered to the government upon completion or termination of this requirement. Likewise, all deliverables generated under this requirement remain the property of the Government. The Government will provide visitor's access to the NIST facilities during the performance of this service contract. If a given hand tool is available, the Government will provide such tools during the performance of a given service call. TRAVEL Travel to the NIST, Boulder, CO is required. CONTRACTOR'S MINIMUM QUALIFICATIONS The Contractor shall provide original equipment manufacturer certified engineers or technicians during the performance of this requirement. Contractor personnel shall have at least two (2) years of experience. Contractor personnel must be US citizens to access the NIST, Boulder, CO campus. TECHNICAL CONSIDERATIONS: Any proprietary information should be so marked. The written capability statement should be received by the Contract Specialist no later than 10:00am Mountain Time, MARCH 16, 2016. The capability statement shall identify the business status of the organization. Only electronic statements will be accepted. Faxes will not be accepted.
