- The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b) (1), with Eaton Corporation, 8609 Six Forks Road, Raleigh, NC 27615-2966 For the renewal of the maintenance/support on two existing Uninterruptible Power Supplies. Sole Source determination is based on the need NIST has for un-interruptable power supply (UPS), and battery banks which are proprietary to the manufacturer, Eaton Corporation. NIST has used Eaton for the initial installation and annual maintenance of Eaton's UPS, and Eaton proprietary software is used to perform diagnostic tests on the UPS equipment. Thus an experienced Field Service Engineer with propriety rights to Eaton's software must perform the maintenance on the UPS. Eaton's technicians are the only known technicians who have proprietary knowledge, tools, and expertise required to safely service NIST's UPS. The National Institute of Standards and Technology (NIST), Acquisition Management Division requires and intends to procure on a sole source basis with Eaton Corporation, Inc. for the support for two UPS For both normal working hours and after hour's support (24X 7). This includes both parts and labor, 4hour response time in the event of an emergency UOS issue, UPS preventative maintenance checks by a certified Eaton UPS technician, twice per year ect..... Eaton does not train, certify or support third party service providers to service its UPS and power quality products. Eaton is the only authorized provider of this service support for the existing UPS, under the authority of FAR 6.302-1 Only One Responsible Source. A firm fixed-price purchase order will be awarded on or about March 30, 2016, for a period of performance of one year. This notice of intent is not a request for quotes (RFQ) and a RFQ will not be issued. However, if an interested party has reason to believe it can meet or exceed this requirement they may submit sufficient documentation to support their claim of capability by March 30, 2016 at 8:00 a.m. EST, via email to sajurnia.harris@nist.gov.
