Description
U.S. General Services Administration GSA Region 7 Leasing Division Justification for Other than Full and Open Competition Lease Number: GS-07P-LLA17161 Project Number: 0AR2069 Agency Name: Social Security Administration (SSA) 1. Identification and Description of Action Being Approved: The General Services Administration currently leases 4,274 rentable square feet (RSF) of office space at 1325 Division St. Blytheville, AR under lease number GS-07B-15053 for the Social Security Administration (SSA). The current lease expires January 6, 2016. Approval is requested to negotiate a superseding lease with the incumbent lessor without full and open competition for continued occupancy at this lease location. 2. Description of Supplies or Services Required: SSA submitted a continuing need letter on May 21, 2012 for 5,221 rentable square feet of office and related space. To satisfy the SSA mission requirements, the facility must be within a walkable distance of public transportation. This requirement is for 5,221 RSF of space for a 10 year term to commence on September 9, 2015. The estimated annual cost of this lease for the 5 year firm term is $32.41 BOMA rentable square feet per year for an annual cost of $169,212.61. The estimated annual cost of this lease for the 5 year soft term is $24.49 BOMA rentable square feet per year for an annual cost of $127,862.29. The estimated total contract value of this lease is $1,485,374.50. The delineated area is the City Limits of Blytheville, AR. 3. Identification of Statutory Authority: 41 U.S.C. 253(c) (1): Only one responsible source and no other supplies or services will satisfy agency requirements 4. Demonstration that the Acquisition Requires use of the Authority Cited: GSAM 570.402-4 allows for negotiation with the incumbent lessor when no potentially acceptable alternates are identified. GSA placed an advertisement conforming to GSAM 570.402-2 on the Federal Business Opportunities Web site (fedbizopps.gov) on May 16, 2012 and received two (2) responses. The incumbent lessor's expression of interest indicated that the rate would be $24.49 RSF. The interested party that provided the lowest cost quoted a rate of $21.10 in its expression of interest. However, the alternate location later withdrew their interest resulting in no potentially acceptable alternates. 5. Description of Efforts to Solicit as Many Offers as Practical: In September 2011, GSA conducted market research and identified zero (0) potentially acceptable locations that might meet the agency's needs within the delineated area. 0AR2069/SSA/Blytheville, AR Justification For Other Than Full And Open Competition PAGE 2 OF 4 Last Revised 2/7/13 In addition, an advertisement was placed in FedBizOpps on May 16, 2012. GSA received only two (2) responses, which are: Incumbent: Kupsch Trust 1325 S. Division St., Blytheville, AR Other: Jonathan Kennedy 2800 S. Division St., Blytheville, AR On August 6, 2012, the alternate location withdrew from competition due to the offered space losing availability. In October 2012, Jones Lang LaSalle Americas, Inc. conducted market research and identified zero (0) potentially acceptable locations that might meet the agency's needs within the delineated area. In April 2013, Jones Lang LaSalle Americas, Inc. conducted market research and identified zero (0) potentially acceptable locations that might meet the agency's needs within the delineated area. In May 2013, GSA conducted market research and identified zero (0) potentially acceptable locations that might meet the agency's needs within the delineated area. 6. Demonstration that the Anticipated Cost will be Fair and Reasonable: In accordance with Federal Acquisition Regulation (FAR) 6.303-2(a) (7), the Contracting Officer determines by certifying this document that the anticipated costs to the Government of $32.41/RSF for the firm term and $24.49/RSF for the soft term requirements are fair and reasonable. Recent market surveys/research conducted by Jones Lang LaSalle Americas, Inc. in Blytheville, AR showed the rental rate within the delineated area ranges from $21.10 to $24.49 per RSF. 7. Description of the Market Survey Conducted: In October 2012, GSA conducted a market survey and in April 2013, Jones Lang LaSalle Americas, Inc. conducted a market survey both of which identified the following location (the incumbent): Market Data for the Area Address Asking Full Service Rental Rate a. 1325 S. Division St. Blytheville, AR $24.49 8. Other Facts Supporting the use of Other Than Full and Open Competition: Blytheville, Arkansas is a rural community with little to no commercial lease transactions. A majority of the commercial transactions are sales. The existing locations is one of the nicest buildings in town with other commercial product being older and unable to meet minimum building requirements. 9.
