- 1.0 Introduction and General Scope. The Laboratory shall furnish all labor, materials and equipment necessary to perform chemical analyses of environmental samples from soil, sediment, and water in support of project design and dredged material suitability determinations for the New England District, U.S. Army Corps of Engineers (USACE), if and when requested by oral instructions from the Contracting Officer or their authorized representative. The Government is obligated only to the extent of authorized purchases made under the Blanket Purchase Agreement (BPA). No individual call under this agreement shall exceed $25,000. The BPA Master Dollar Limit is $100,000.00. This agreement shall remain in place for one year from the date it is put in place. In accordance with FAR 13.303-3(a)(2), the Government is obligated only to the extent of authorized purchases actually made under the BPA. 2.0 Requirements 2.1 General. The quotation shall include a price schedule for all analyses and services the laboratory can provide. This list shall include surcharges for expedited turn-around times. The quotation shall also demonstrate that the laboratory is capable of providing pre-preserved bottle ware as needed. Other requirements specific to laboratory qualifications and capabilities which shall be demonstrated in the quotation are as follows: 1. The lab shall be located within the footprint of the New England District states in order to facilitate transport and minimize the risk of exceeding sample holding times. 2. The laboratory shall have a Laboratory Quality Assurance Plan (LQAP) which meets the requirements of the Regional Implementation Manual ("Regional Implementation Manual for the Evaluation of Dredged Material Proposed for Disposal in New England Waters" (EPA/USACE, 2004)) and has been accepted by the Regulatory Division of NAE. This acceptance must indicate that the lab is able to provide data that for bulk chemical analysis of sediment metals, PAHs, and PCBs, as well as both fresh and saltwater aqueous chemistry. A list of laboratories with accepted LQAPs as well as the types of analyses they perform that will be accepted by NAE can be found on the NAE Regulatory Division website: http://www.nae.usace.army.mil/Portals/74/docs/regulatory/DredgedMaterialProgram/LabList3Mar2013.pdf 3. The laboratory must be able to meet the requirements set forth in the Regional Implementation Manual related to analytical reporting limits for the various tiers of evaluation, sample handling protocols, quality assurance/quality control measures, and Electronic Data Deliverables (EDDs) (Details at http://www.nae.usace.army.mil/Missions/Regulatory/DredgedMaterialProgram/RegionalImplementationManual.aspx). The requirements in the Regional Implementation Manual shall be applied in conjunction with the national guidance found in the Ocean Testing Manual ("Evaluation of Dredged Material Proposed for Ocean Disposal - Testing Manual" (EPA/USACE, 1991)); the Inland Testing Manual ("Evaluation of Dredged Material Proposed for Discharge in Waters of the U.S. - Testing Manual" (EPA/USACE, 1998)), and the Quality Assurance/Quality Control Manual ("Guidance for Sampling and Analysis of Sediments, Water and Tissue for Dredged Material Evaluations: Chemical Evaluations" (EPA/USACE, 1995) 4. The Laboratory shall also state that it will comply with all requirements of the DoD Quality Systems Manual (QSM), Final Version 4.2, dated October 25, 2010 or more recent version. 2.2 Data Management. The quotation shall indicate that the laboratory is capable of reporting data using the NAE EDD format and of meeting the requirements of this section of the Statement of Work. The minimum deliverables to be provided by the laboratory for each project shall include applicable EDDs depending on the required analyses, a.pdf document file of the laboratory's final data report, and a hard copy of the laboratory's final data report. For certain projects a staged EDD (SEDD) 2a for processing through USACE automated data review (ADR.net) may be requested. The laboratory shall make available any supplemental information (e.g. chromatograms, instrument calibrations) upon request. The Laboratory shall electronically review each EDD file using the NAE EDD Checker software to ensure that the data file is error free. It is the responsibility of the laboratory to ensure that all EDDs are error free before final submission. If any minor errors persist after correction to the EDD file, then the Laboratory shall submit with the EDD a copy of the error/warning report along with a written explanation of each. All electronic data submitted by the Laboratory is required to be error-free, and in complete agreement with the hardcopy data. Data files are to be delivered by e-mail, high density CD, or ftp site. This deliverable shall accompany a pdf of the hardcopy data reports. The data files must be submitted with a transmittal letter from the Laboratory that certifies that the files are in agreement with hardcopy data reports and has been found to be free of errors using the latest version of the EDD Checker. The Laboratory, at their cost, will correct any errors identified by the USACE, New England District. The Laboratory will follow the Chain of Custody with respect to requests for analyses, data deliverables, and any project specific instructions unless amended by USACE Project Chemist. 2.4 Invoices. Invoices shall be submitted upon completion of work and delivery of data files and reports. Invoice shall contain the following information: • BPA number • BPA call number • Project name • Sampling date(s) • Deliverable date(s) • Itemized list of analyses and associated costs • Summary of any issues or corrections • Copy of Chain of Custody 2.5 Pricing. Individual analysis rates under this agreement shall be determined prior to the contract award based on the Laboratory's response to the sample call as specified below. 3.0 Evaluation Criteria The Laboratory will be selected for this BPA based on a demonstrated capability of meeting the requirements of Section 2.0 and by providing the lowest total cost for a sample call against the BPA. The sample call shall consist of the analyses specified in Table 1. For the purpose of this sample call it is assumed that the analytical results will be submitted to the NAE Regulatory Division and the US Environmental Protection Agency (EPA) Region 1 in support of a dredged material suitability determination, so all protocols and analytical reporting limits must be compliant with the Regional Implementation Manual. The analytical methods listed in Table 1 are recommended but can be replaced by other methods that will meet the required reporting limits. Along with their proposed costs, the laboratory shall submit their proposed analytical methods, Limits of Detection (LODs) and Limits of Quantitation (LOQs) for the required analytes as well as measurement performance criteria for precision and accuracy. This sample call shall be assumed to be the first call against the BPA. Therefore, the cost estimate must include any costs associated with being able to meet the accreditation and data management requirements of Section 2.0 above. 4.0 Coordination Once a call is made against the BPA, liaison will be maintained for the duration of the call through periodic communications with the USACE Chemist assigned to the project. 5.0 Permits. The Contractor, without additional expense to the Government, shall be responsible for obtaining any necessary licenses, permits, and letters of certification. The Contractor shall comply with any applicable Federal, State, County, and Municipal laws, codes, and regulations in connection with the performance of the work specified under this contract. 1.0 Introduction and General Scope.
