- Part 352—Solicitation Provisions and Contract Clauses _ HHS 52.203-99 Prohibition on Contracting 52.203-98 Prohibition on Contracting FAR 52.212-5 FAR 52.212.4 FAR 52.212-3 FAR 52.212-1 Statement of work sole source justification This notice is a Notice of Intent (NOI). The Government intends to negotiate on a sole source basis with Thermo electron North America for a Unity Essential Support Plan Renewal. This acquisition will be made in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 "Streamlined Procedures for Evaluation and solicitation for commercial Items," as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are not being requested and a written solicitation will not be issued. This acquisition will be processed under FAR Part 13 Simplified Acquisition Procedures (SAP) and FAR 13.501 Circumstances permitting other than full and open competition. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-88 May 16, 2016. The North American Industry Classification System (NAICS) code for this procurement is 811219, Software Publishers, with a small business size standard of $20.5M. The National Institute of Allergy and Infectious Diseases (NIAID) intends to procure on a sole source basis from Thermo electron North America for a Unity Essential Support Plan Renewal. Place of Performance: NIH, 12735 Twinbrook Parkway, Rockville, MD 20852, United States. FOB: Destination The government intends to award a firm fixed price purchase order to the responsible contractor as a result of this notice of intent will include the terms and conditions set forth herein. The award will be based on the following; price, capability to meet the requirements, delivery and the best value to the government.
