License Agreement Sole Source Justification & Approval THIS IS NOT A REQUEST FOR QUOTE - THIS IS A NOTICE OF THE GOVERNMENT'S INTENT TO ISSUE A SOLE SOURCE AWARD CONTRACT TO TERRY STEINER INTERNATIONAL FOR TELEVISION PROGRAMMING This is a Notice of Intent to issue a firm-fixed-price contract for a base year and four option years to Terry Steiner International, Inc., 130 West 57th Street, Suite 10-B, New York, NY 10019 on a sole source basis under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, 10U.S.C. 2304(c)(1). Sole Source Justification is attached hereto. The proposed procurement is for television programming currently licensed/distributed by Terry Steiner International, Inc. for the American Forces Network - Broadcast Center (AFN-BC), located at the Defense Media Activity, 23755 Z Street, Riverside, CA 92518. a. DESCRIPTION: CLIN 0001: Television Programming - Base Year The contractor shall provide broadcast rights to Scripps Networks television programming currently aired on Food Network, Cooking Channel, HGTV, DIY Network, Travel Channel and GAC and any other succeeding channels to AFN-BC to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites and cleared promos per the attached license agreement. License Period: October 1, 2016 through September 30, 2017. CLIN 1001: Television Programming - Option Year 1 The contractor shall provide broadcast rights to Scripps Networks television programming currently aired on Food Network, Cooking Channel, HGTV, DIY Network, Travel Channel and GAC and any other succeeding channels to AFN-BC to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites and cleared promos per the attached license agreement. License Period: October 1, 2017 through September 30, 2018. CLIN 2001: Television Programming - Option Year 2 The contractor shall provide broadcast rights to Scripps Networks television programming currently aired on Food Network, Cooking Channel, HGTV, DIY Network, Travel Channel and GAC and any other succeeding channels to AFN-BC to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites and cleared promos per the attached license agreement. License Period: October 1, 2018 through September 30, 2019. CLIN 3001: Television Programming - Option Year 3 The contractor shall provide broadcast rights to Scripps Networks television programming currently aired on Food Network, Cooking Channel, HGTV, DIY Network, Travel Channel and GAC and any other succeeding channels to AFN-BC to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites and cleared promos per the attached license agreement. License Period: October 1, 2019 through September 30, 2020. CLIN 4001: Television Programming - Option Year 4 The contractor shall provide broadcast rights to Scripps Networks television programming currently aired on Food Network, Cooking Channel, HGTV, DIY Network, Travel Channel and GAC and any other succeeding channels to AFN-BC to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites and cleared promos per the attached license agreement. License Period: October 1, 2020 through September 30, 2021. This notice of intent is NOT a request for proposals or quotations. Requests for copies of a solicitation in response to this notice will not be honored or acknowledged. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether conducting a competitive procurement is in the best interest of the Government. Responses must be in writing and must provide clear and concise documentation indicating an offeror's bona fide capability to provide this service. Verbal responses are not acceptable and will not be considered. The Government reserves the right to cancel the Sole Source Award. The primary North American Industry Classification System (NAICS) code is 512120 - Motion Picture and Video Distribution, and the small business size standard is $32.0M. This notice of intent is not a request for competitive quotations; however, all responses received within seven (7) days of the issuance of this notice will be considered by the government. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
