Description
The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with JEOL USA, Inc., located at 11 Dearborn Road, Peabody Massachusetts, 01960, to purchase a Model JMS-T100LP-DART-4G Time-of-Flight (ToF) Mass Spectrometer with a Corona ESI Ion Source (Model: MS-54050CES) and nitrogen tank (MS-50030NT) to allow for more rapid quantification of forensic compounds. The sole source justification is based on the following: NIST requires a time-of-flight mass spectrometer, direct analysis in real time source, and the necessary computer system and software to run the system. The system must also be directly compatible with current government owned technologies and databases that are designed to work with a JEOL JMS T100-LP mass spectrometer. NIST previously purchased a JEOL JMS T100-LP time-of-flight mass spectrometer and additional measurement capabilities specific to this instrument. These additional components are designed to directly mount to the JEOL JMS T100-LP in a manner that cannot be replicated with any other known mass spectrometer without purchasing duplicate accessories. Also, NIST created search databases and spectral libraries that are specific to this system to aid in analyses using this instrument. NIST requires that the new ToF Mass Spectrometer be directly compatible with the accessories and databases already developed or owned by NIST. The JEOL JMS T100-LP was the only ToF Mass Spectrometer discovered during market research that can meets NIST's specifications and is compatible with the NIST-owned accessories and NIST-developed databases. Given these facts, JEOL USA, Inc. is the only source reasonably available to provide the required equipment and software. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 334516 with a size standard of 1,000 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 11:00 am EST 27 July 2016, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
