- Description
- The Office of Acquisition and Agreements Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole source basis with Johnny Kirkland of Shorham, NY, to provide modifications of the ESRF U42 compatible with XDAC software. The National Institute of Standards and Technology (NIST) operated five (5) synchrotron beamline laboratories at the National Synchrotron Light Source (NSLS) located at the Department of Energy's Brookhaven National Laboratory. NIST had beamlines at the NSLS until it ceased operation of the beamlines on September 30, 2014. The five beamlines were the U-04A, U07A, U-08B, X-23A2, and X-24A. The acquisition and control software for these beamlines is called X-Ray Data Acquisition and Control Software (XDAC). Starting in fiscal year (FY) 2015, NIST moved its synchrotron operations to NSLS-II and is using the XDAC software. NSLS-II is located at Brookhaven National Laboratory. The XDAC software is proprietary software that has been in use by NIST for over ten years. NIST requires a physical modification of the NIST SST undulator for use at NSLS-II; referred to as the European Synchrotron Radiation Facility (ESRF)U42 undulator, that is fully compatible with the beamline data acquisition and control software. The undulator is a new part of the NIST NSLS-II beamlines. XDAC control of the undulator is required for operation of the beamlines. The total period of performance shall be a base period of one year and two one-year option periods. Different work shall be performed in the base period and each one-year option period. The NAICS code for this requirement is 334516 and the small business size standard is 500 employees. Sole source determination is based on the following: In FY15 and FY16, modification of beamline X-ray Data Acquisition and Control software from format and hardware compatible, to NSLS, to NSLS-II format and hardware was accomplished by Johnny P. Kirkland under NIST purchase order numbers SB1341-14-SE-0382and SB1341-15-SE-0406. Purchase order number SB1341-14-SE-0382. Work required under purchase order number SB1341-15-SE-0406 is scheduled to be completed on September 30, 2016. As the software is interdependent on the hardware, Johnny Kirkland is the only vendor that can accomplish the needed modification of beamline data acquisition and control software (XDAC) format and hardware compatible to NSLS to NSLS-11 format and hardware. The XDAC software and interface were authored by Johnny Kirkland. The software and the interface are proprietary to Mr. Kirkland. Mr. Kirkland owns all rights and privileges to the software and interface and has no resellers. NIST does not possess data rights to the software product. The proprietary XDAC software and interface to the beamline hardware cannot be maintained or upgraded by another source. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by August 18, 2016, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
