- J&A MICC Control No. West Point-2016-75< SAT SOLE SOURCE JUSTIFICATION Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $150K 1. Agency/Contracting Activity: Mission and Installation Contracting Command- West Point MICC-WP 2. Description of Action: Six (6) Museum quality Glasbau Modular Hahn-Louda System (HLS) System Exhibit Cases Nature: New Requirement Contract Number Pricing: Firm-Fixed Price Time and Materials Funds: OMA Other Funds 3. Description of Supplies: a. The total estimated dollar value of the proposed action is $50,000.00 b. The US Army Museum on West Point requires a Sole source purchase of six (6) Museum quality Glasbau Modular HLS System Exhibit Cases. Delivery date 09/30/16. 4. Authority: Action using Simplified Acquisition Procedures FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.urgency, exclusive licensing agreements, brand name, or industrial mobilization. 5. Reason for Authority Cited: The West Point Museum requires modular exhibition display cases for the versatile, secure and safe public display of Army Historical property. In accordance with Army Regulations (AR) 870-20 3-15 f and 190-51 5-8, the Museum must provide a physically secure and stable environment for the correct display of Army historic artifacts. US Army Museum at West Point, utilize display cases which incorporate conservation grade materials (AR 870-20 3-15 f) and comply with conservation standards established and mandated by the US Army Center of Military History (AR 870-20 3-18). The requirement for the modular cases is to replace obsolete, limited capability display cases (failed seals, inadequate material construction, general wear and tear from decades of use, plate glass as opposed to safety glass, inadequate or stripped security screw locking systems) which no longer meet the environmental and physical security standards of Army Regulations. Furthermore, the requested vendor is the sole provider of cases which match Glasbau Modular HLS System Exhibit Cases in use by the US Army Center of Military History. Other museum quality exhibit case manufacturers design and produce similar cases that can be broken down and transported; however, the other cases manufactured do not utilize the Patent 6543865 for the joining of modular components proprietary to Glasbau Modular HLS System Exhibit Cases. In that regard, the highly efficient modular qualities/advantages for securely joining cases in an expansive and for that matter unlimited array of physical display configurations that retain the required conservation stable and physically secure environment may very well be lost. The ability to effectively create rotating and varied artifact based educational exhibits will be constrained in the ability will be constrained in our ability to effectively create rotating and varied artifact based educational exhibits unique to the military training and education of the United States Corps of Cadets (USCC) which will work with or expand upon existing Glasbau - Hahn HLS hardware. Subsequently, the Museum will fall short in its ability to prepare meaningful exhibits that comply with the approved storyline as issued by the United States Army Center of Military History' Programs Branch, special exhibitions, and most importantly maintaining a highly versatile, conservation friendly secure artifact environment. 6. Actions to Increase Competition: A sole source sources sought was posted on Federal Business Opportunities website 07/07/16 - 07/20/16 There were no small businesses who responded to the notice to supply the six (6) Museum quality Glasbau Modular HLS System Exhibit Cases. Market Research: Market research for this procurement included posting a Sources Sought notice on 07/07/16 - 07/20/16, which did not yield any results from any small businesses. In addition, a search of the SBA website found 1294 small business entities that could provide the six museum exhibit cases. 8. Procurement History: Previous Purchase Orders(s) or Contract(s): Yes Purchase order or contract number:W911SD-04-P-0457 Was action competed? Yes 9. Additional information to support the justification: Each modular unit utilizes Patent 6543865 for the connection of members and support frame pieces. This is imperative to insure individual opening of panels at each side of the case and utilization with existing Glasbau Modular HLS System Exhibit Cases. Each module contains an upper frame support and lower frame support. Each of the frame supports include carrying frame sections and corner connecting members. The Carrying frame members are adapted to be rigidly connected to the corner connecting members. At least one intermodule connecting member interconnects adjacent modules. At least one intermodule connecting member is adapted to be rigidly connected to the corner connecting members of the adjacent modules. The corner connecting members are formed as prisms and have grooves on vertical surfaces for engagement with protrusions contained on the carrying frame sections or the at least one intermodule connecting member. At least one glass panel is disposed between each upper frame support and lower frame support of the adjacent modules on the carrying side edge of one of the at least one glass panel is fitted with a seal which is in contact with the other of the at least one glass panel. 10.
