- This notice announces the intent by the U.S. Army Medical Research Acquisition Activity (USAMRAA) in support of U.S. Army Medical Materiel Agency (USAMMA) to purchase the medical equipment parts listed below on a sole source basis from the Original Equipment Manufacturer (OEM), Philips Healthcare, 22100 Bothell Everett HWY, Bothell, WA 98021, as prescribed in FAR 13.106-1(b)(1)(i). C & Up; Qty: 2 453567374732 SATA Hard Drive (System Dri; Qty: 2 The North American Industry Classification System (NAICS) for this requirement is 339112 and the size standard is 1,000 employees. These items are needed at a USAMMA depot at Tracy, CA which repairs and replaces Medical equipment used by deployed forces in theater. Medical equipment repair parts are available only from the manufacturer of the equipment or from a firm that has been licensed by the manufacturer to produce authorized parts. This conclusion is based on Army Regulations and market research. Army Regulation (AR) 40-61, Medical Logistics Policies, prohibits modifications or alterations of Army medical equipment without the manufacturer's consent. Section 6-17 provides that even "minor alterations without the manufacturer's consent may negate any further manufacturer product liability." AR 40-61 lists four circumstances under which Army medical maintenance personnel may modify medical equipment: modification work order, quality assurance alteration, minor alteration, and component modernization. All require manufacturer involvement or consent. Based on the initial market research completed by the Government, the specific parts listed above, which are needed for Computerized Tomography (CT) equipment, are available only from the manufacturer directly. Furthermore, the OEM stated that if these parts were purchased from an unauthorized third party and installed in a Philips CT system, this system would then become ineligible for future service contracts with Philips Healthcare. Therefore, based on the justification stated above, this would also violate AR 40-61 as the OEM has directly informed the Government that there are no authorized resellers for the CT equipment repair parts required at this time. This announcement fulfills the synopsis requirements under 5.203(a). This Special Notice of Intent is not a request for competitive quotes. Information received in response to this notice will be considered solely for the purpose of determining whether a competitive procurement is in the best interest of the Government. If no written responses are received by the date listed below, which reflects 17 days after the publication of this notice, the government intends to issue an award directly to Philips Healthcare.
