- Based on the market research accomplished, both the McDermott Library staff and 10 CONS personnel monitored and surveyed the market to determine capabilities from vendors other than EBSCO Industries, Inc. Requests for Information were accomplished on both GSA and FBO, but no other vendors were capable of providing all requirements. The actions stated in the Section XI of the 2015 Justification and Approval for the previous award to overcome barriers to competition were ccomplished. I. Contracting Activity. HQ USAFA / 10 CONS / LGCB II. Nature and/or description of the action being processed. EBSCO Industries, Inc. is the only source with the capability and intellectual property content that satisfies all of the United States Air Force Academy (USAFA) University Library Products requirement, to include Journal and Database Subscriptions and Resource Management Services. The Library Products/Services will be awarded sole source through a Firm-Fixed-Price (FFP) contract, with an anticipated schedule of 15 August 2016 through 14 August 2017; however, contract period will start on the day of award and continue for one (1) year. III. Description of supplies/services required to meet agency needs. University Library Products and Incidental Resource Management Services University Library Products: USAFA requires access to collegiate-level databases, on-line subscriptions (both individual publisher and publisher packages), full text on-line journals, periodicals, newspapers, e-Books, microfilm and microfiche as indicated in the product list. The library products will be utilized by approximately 4,500 students and staff at the McDermott Library. The products shall be available in USAFA's prescribed format. The products shall be indexed in an A-Z fashion and shall be searchable in such a manner that allows discovery of any of the electronic resources offered in the collection from a single search. The index shall include meta-data describing the library's complete holdings, so that the search tool allows users to discover e-journals and browse publications full-text directly from the search results. The search tool shall list the library's resources and holding information, from all subscribed database vendors and publishers, through a single menu at the top of the discovery page (or via an exportable widget) including e-journals, publications within full-text databases, publisher packages, e-Books, print and other local resources. The electronic catalog records for USAFA's required products shall be supplied in the format prescribed by the Resource Description and Access (RDA) guidelines and Anglo-American Cataloging Rules (AACR), to include but not limited to RDA, MARC21, Dublin Core and BIBFRAME, e.g. photos are cataloged in Dublin Core, print monographs in RDA compatible MARC21 and subscription products in MARC21. The vendor shall manage claims, address changes, cancellations, real time analytical reports of product usage, training, expenditure tracking, publisher information and on-line services to subscriptions. Incidental Subscription Management Services: The vendor shall support multiple shipping addresses under one billing address. The vendor shall supply data for all titles to include a full history of title changes, frequency changes, license agreements, activation requirements, fund codes assigned to a title, price with sums and subtotals, invoice number, payment date, expiration date, publisher, format, shipping address, subject classification and the full history of issue status of all supplied publications. The reports tool must provide display and sorting options which enable the user to results by any reported facet. IV. Statutory authority permitting Other than Full and Open Competition. Authority 41 U.S.C. 1901 as implemented by FAR 13.501(a)(1)(ii) is being utilized, not FAR 6. EBSCO Industries, Inc. is the sole source for this requirement as described in FAR 6.302-1. FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items; (a) This subpart authorizes the use of simplified procedures for the acquisition of supplies and services in amounts greater than the simplified acquisition threshold but not exceeding $7 million, including options, if the contracting officer reasonably expects, based on the nature of the supplies or services sought, and on market research, that offers will include only commercial items. FAR 13.501 (a)(1)(ii) Prepare sole source justifications using the format at FAR 6.303-2, modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901 or the authority of 41 U.S.C. 1903. FAR 13.501 (a)(2)(ii) For a proposed contract exceeding $700,000, but not exceeding $13.5 million, the advocate for competition for the procuring activity, designated pursuant to FAR 6.501; or an official described in FAR 6.304(a)(3)or (a)(4) must approve the justification and approval. This authority is not delegable. V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority). USAFA's McDermott Library requires access to over 125,000 on-line subscriptions, 4000 e-Books and 300 print subscriptions. The library products come from a multitude of publishers. Each publisher has different periods of performance and usage terms. To purchase each subscription independently from the original publisher would be an ineffective use of funds and time. USAFA does not have adequate manpower to manage each subscription once it is procured. Therefore,.is the most cost effective means for this procurement. Due to limited manpower and budget constraints, USAFA requires that all of its library products, to include on-line subscriptions be purchased and managed from one vendor. The only vendor that can supply USAFA's University Library Products, to include Journal and Database Subscriptions and Incidental Resource Management Services is.This requirement has been procured from the same single source for the past six years. Each year, the market is queried to determine if there is a new source available. In 2016, EBSCO Industries, Inc. is the only source that can provide all of the library products and incidental services. VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable. In order to reach out to a large database of vendors, a Request for Information (RFI) Sources Sought was posted on FedBizOps and GSA eBuy on June 20, 2016 to identify any and all vendors who may have the capability to provide the library products and incidental services requested in the sources sought. In that RFI, the Government asked the following questions: 1. Are you interested in providing this requirement? If so, please provide the following: DUNS, CAGE, Business Type and Size under NAICS 424920. 2. Can you provide all the Library Publications and Subscription products identified on the attached product list? If not, please identify which products can't be provided and why? When the Sources Sought RFI closed on June 27, 2016, three vendors had responded. Only one vendor, EBSCO Industries, Inc, a large business and the current sole source incumbent contractor, responded with supporting documentation (product list) that directly addressed the entire requirement. VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. Past invoices from. and individual publishers have been used to establish a government estimate. The 2016 inflation rate from an academic publishing report from the American Library Association has also been factored into the government's estimate. The ordering activity has concluded that a contract with represents the best value and the lowest overall cost alternative to meet the Government's need. The Contracting Officer will determine to be fair and reasonable in accordance with FAR 13.106-3. To evaluate the quotes, the Contracting Officer will utilize price analysis techniques based on the Government's independent estimate, historical acquisitions and market research. VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted. As previously stated in Section IV., 10 CONS/LGCB submitted RFI on FedBizOps and GSA eBuy on June 20, 2016 to maximize awareness of USAFA's McDermott Library requirement and solicit interest from potential participants in a full and open competition. EBSCO Industries, Inc. was the sole responding vendor to fully address the requirement. There was one incomplete response from which expressed interest but failed to address the titles available and not available as specified in the RFI. There was another incomplete response from, which provided a partial match against the requirement but failed to address key elements. For example, could not provide 216 of the 560 title requirement and is unable to provide key titles such as "The Journal of Aerospace Engineering," "Unmanned Systems (Mission Critical)", "War and Society," "The Journal of Strategic Studies," or "Journal of Military Ethics." They did not reply addressing key packages, such as Project MUSE and possible substitutes for the EBSCO Industries, Inc. proprietary databases, such as EBSCO Academic Search Complete. The USAFA McDermott Library has proactively sought and reviewed published materials of competitors. and to seek matching capability, and found that seem focused on civilian educational institutions and on the European market. Given their lack of response to an RFI, it is unknown, at this time, if they could support the scope of the requirement, are interested in serving government libraries, or are competing in the same specialized space. Previous awards for this requirement have been made by delivery order placed against EBSCO Industries, Inc. GSA Schedule GS-02F-1402H. All products/incidental services are not currently available on GSA Schedule. As a result, it was determined that the procurement of this requirement will made through FedBizOps versus GSA. IX. Any other facts supporting the use of Other Than Full and Open Competition. N/A X. List of sources, if any, that expressed interest in the acquisition. XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required. McDermott Library staff will continue to monitor the market of journal and database subscription providers to gauge the extent to which current providers have increased their capability, and whether the entry of new providers offering services with the scale and depth of information required has precluded a follow-on single source award. RFI's will be issued before future award to maximize awareness of the requirement and to invite any interested parties to provide information on their capabilities and submit a bid in full and open competition. Although vendors received the library product list through the 2016 RFI Sources Sought posting, 10 CONS/LGCB intends to notify in regards to USAFA McDermott Library's 2017 re-acquisition. Vendors will be provided with a library product list and statement of work. Vendors will be contacted in 2017 to see if they have incorporated these library products and services into their repertoire. XII. Certification by the Contracting Officer.
