- DEPARTMENT OF VETERANS AFFAIRS (VA) REQUIREMENT FOR LEASE SPACE The VA is currently seeking lease space for a Community Based Outpatient Clinic (CBOC) in Minot, North Dakota and is conducting an open market competition for space. The space must be on no more than one floor, and provide 9,600-9998 NUSF of space. On-site parking for 50 vehicles is required. A full service lease for up to 10 years, with 5 years firm is contemplated. Term to be finalized prior to solicitation issue. Occupancy is desired by 1 January 2018. The space to be considered shall be within the Minot, North Dakota delineated area as follows: NorthAn East/West line located at approximately 46th Avenue NE EastA North/South line located at approximately 55th Street SE SouthAn East/West line located at approximately 40th Avenue SW WestA North/South line at approximately following the Highway 83 By-Pass Offerors must provide evidence that properties are outside the 100-year flood plain. The VA Rule of Two applies to this potential procurement. VA Rule of Two- means the process in 38 U.S.C. 8127(d) whereby a contracting officer of the Department "shall award contracts on the basis of competition restricted to small business concerns owned and controlled by veterans, if the contracting officer has a reasonable expectation that two or more small business concerns owned and controlled by veterans will submit offers, and that the award can be made at a fair and reasonable price that offers the best value to the United States." For purposes of this VA specific rule, a service-disabled veteran-owned small business (SDVOSB) or a veteran-owned small business (VOSB), must meet the eligibility requirements in 38 U.S.C. 8127(e), (f) and VAAR subpart 819.7003 and be listed as verified in the Vendor Information Pages (VIP) database. A formal market survey of prospective properties will be conducted by the VA. The Government is limited by law (41 C.F.R. § 102-73.55) to pay no more than the appraised fair rental value for space. RESPONDENTS ARE ADVISED THAT THE VA ASSUMES NO RESPONSIBILITY TO AWARD A LEASE BASED UPON RESPONSES TO THIS ADVERTISEMENT. THIS IS NOT A SOLICITATION.
