- THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT MODIFICATION WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION. THIS IS NOT A REQUEST FOR PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. This notice is being published by the National Institute of Environmental Health Sciences (NIEHS) in accordance with Federal Acquisition Regulation (FAR) Part 5.201 and 5.204 requiring notice of a proposed contract action. This is a notice of intent to extend the services provided under NIEHS Contract Number N01ES75564 with Research Triangle Institute. This is NOT a request for competitive proposals. The statutory authority for this sole source action is 41 U.S.C. 253(c)(1) as implemented by FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. Inherent duplication of cost to the Government and delays in service make competition not feasible for the extension. Award of the modification is subject to Justification for Other Than Full and Open Competition (JOFOC) approval. The National Institute of Environmental Health Sciences (NIEHS) intends to issue a sole-source modification to extend the performance period of Contract Number N01ES75564 in accordance with FAR 6.302-1 and HHSAR 306.302-1. This extension will provide the National Toxicology Program (NTP) with service and support for end-of-contract activities on the Reproductive Assessment by Continuous Breeding (RACB) contract for up to one (1) year beyond the current expiration date of December 15, 2016. RTI is the only source capable of providing uninterrupted and comprehensive service to NIEHS to finalize the work under the RACB contract. RTI, as the incumbent contractor, is the only source that can provide the access to the necessary staff and information that will be needed to clarify questions on final reports and to provide additional information that may be necessary. Because RTI is the contractor that performed the studies and drafted the reports, it is the only contractor that has access to the data and is capable of providing the expertise to interpret, clarify and, if necessary, provide updated/corrected information from final reports that have been submitted under the contract. Failure to extend the contract will result in unacceptable delays in fulfilling the agency's congressionally mandated requirements. A recompetition of this contract is NOT expected. This notice of intent is NOT a request for competitive proposals. However, the Government shall consider all responses from interested parties received within fifteen (15) days of this posting. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Written responses to this synopsis shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. NIEHS will not be responsible for any costs incurred by interested parties in responding to this notice. ONLY EMAIL RESPONSES WILL BE ACCEPTED.
