- N otice Type: Special Notice of Contract Action J&A Statutory Authority: FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. Contract Award Date: Anticipated 1 st Quarter FY 17 Contract Award Number: FA8726-08-C-0004 Synopsis: The Space, Aerial and Nuclear Networks Division (AFLCMC/HNAK) proposes to execute, by means of other than full and open competition, a contract to the Raytheon Company, 1001 Boston Post Road East, Marlborough, MA 01752-3770. This contract will provide the above mentioned seven (7) refurbished racks for use as Government furnished support equipment under contract FA8726-08-C-0004. The award of this contract will requires that the contractor shall install A-kit and B-kit spares into the refurbished racks and shall have up to six (6) months from receipt of the empty racks to deliver the seven (7) completed terminals to the Communications Installations and Sustainment Support Contract for installation. The CAGE Code is: 7Y193; the NAICS Code is: 334220. The authority permitting other than full and open competition is 10 USC 2304(c)(1), as implemented as follows: - FAR 6.302-1(a)(2) - When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. FAR 6.302-1(a)(2)(iii)(B) further goes on to state that for DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency's requirements. The Government requests that initial feedback, comments and questions be received by not later than fifteen (15) calendar days from the date of this notice posted to www.fbo.gov. Any response submitted by respondents to this Notice of Contract Action constitutes consent for that submission to be reviewed by Government personnel, Federally Funded Research and Development Center employees and Advisory & Assistance Services contractor employees, unless the respondent clearly objects in writing to the release of this information to Federally Funded Research and Development Contractor employees and Advisory & Assistance Services Contractor employees. An AFLCMC/AQP Ombudsman is available to consider and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. Before consulting the Ombudsman, concerned parties should first address their concerns, issues and disagreements, and/or recommendations to the listed Contracting Officer above for resolution. The AFLCMC/AQP Ombudsman located at Wright Patterson AFB, OH, serves as the Ombudsman for all of AFLCMC/Hanscom-OL, including its GSUs. The Ombudsman hears concerns about specific issues in acquisitions from industry or Government personnel, communicates those concerns to AFLCMC/Hanscom-OL leadership, and assists in the resolution of those concerns. The Ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes, nor does the Ombudsman diminish the authority of the program manager, contracting officer, or source selection official. When approached with an issue or query, the Ombudsman independently assesses the situation and provides a response or initiates a resolution, and when requested, will maintain confidentiality as to the source of the inquiry. Synopsis: This announcement constitutes a Notice of Contract Action (NOCA) by the Air Force Life Cycle Management Center (AFLCMC) Hanscom AFB, MA. The Government intends to issue a sole source award to provide seven (7) refurbished racks for use as Government furnished support equipment at MMPU depots, engineering locations, and/or operational launch control centers. This is a short-term contract that is critical to the MMPU installation schedule and is necessary to enable the subcontractor to meet delivery deadlines in order to support fielding of MMPU terminals and to train the operators.
