DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA250-17AP-0590 Contracting Activity: Department of Veterans Affairs, VISN 10, Louis Stokes Cleveland VA Medical Center 541-17-250-0023 Nature and/or Description of the Action Being Processed: The Louis Stokes Cleveland VA Medical Center Optometry and Ophthalmology sections are requesting a Spectralis Tracking OCT System for the outpatient clinics. They system will enhance veteran eye care by enabling improved diagnostic and therapeutic outcomes by providing clinicians advanced imaging analysis of a multitude of retinal and glaucoma conditions not otherwise obtainable with conventional imaging technologies. The role of OCT imaging in eye care has transcended modern day management techniques and will continue to drive retina and glaucoma care, both of which have a very high prevalence in the veteran population. Description of Supplies/Services Required to Meet the Agency s Needs: The Louis Stokes Cleveland VAMC is requesting the following item for Ophthalmology and Optometry Clinics located at the main Medical Center 1 EA of 0226-HRAOCT2 Spectralis Tracking OCT System - HRA+OCT w/OCT2 MultiColor. One complete unit capable of providing the following functions: 1)Fourier (spectral) domain optical coherence tomography (OCT) a. Anterior and posterior segment 2)Fundus photography a. Color b. Red-free c. Autofluoescence 3)Retinal angiography a. Fluorescein i. Standard ii. Wide field b. Indocyanine green Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 (X) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Authorized or Required by Statute (FAR 6.302-5) (6) Sole source awards under the Veterans Benefits Act of 2003 (15 U.S.C. 657f). L1 ENTERPRISES, INC. is the only SDVOSB capable of providing equipment capable of performing the required functions. L1 ENTERPRISES, INC. is providing the product of another Small Business and is recognized by the manufacturer as the authorized distributor. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: In the course of the market research the previous acquisition552-A50022 was reviewed. 552-A50022 was posted and only received one response. At this time the Government does not have a reasonable expectation that any new products or distributors have entered the market. Heidelburg was contacted and confirmed that L1 Enterprises is their distributor. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost to the Government is in line with the IGE and previous acquisitions. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: L1 Enterprises, Inc. a Service Disabled Veteran Owned Small Business that offers the recommended items as an authorized distributor of Heidelberg Engineering the recommended equipment. In total there are 25 contractors in category A-35 Vision Screening and Test Equipment 9 Large Businesses, 2 SDVOSB, and 14 other Small Businesses with NAC Contract. Currently no equipment on NAC meets the needs of the Government. 333314 Optical instrument and lens manufacturing, was also found on the waiver list for the non-manufacturer rule. In addition to the non-manufacturer rule both Heidelberg Engineering and their distributor L1 Enterprises were listed on SAM as a Small Business. L1 Enterprises has been verified in Vetbiz as a SDVOSB. Any Other Facts Supporting the Use of Other than Full and Open Competition: The previous acquisition 552-A50022 only received one quote from L1 Enterprises (SDVOSB).
