The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-93, January 10, 2017. This announcement constitutes the only solicitation: proposal being requested and a written solicitation will not be issued. The Government intends to make one separate firm-fixed price awards for each "Legal Publication Subscriptions". The NAICS code for this requirement is 511120. A single purchase order will be awarded. Also, provided in full text are CFTC staff letters, advisories and studies issued by the Commission. Full text is also provided for proposed and final Commission regulations, and for relevant Congressional bills and testimony. • Federal Banking Law Reporter - comprehensive guidance on the federal regulation of banks and thrifts. Full text of laws and regulations, and expert analyses and explanations given by CCH editors. • Municipal Securities Rulemaking Board manual - official publication of the MSRB, provides municipal securities professionals with complete and current information concerning the regulations and requirements that govern the conduct of a municipal securities business. When an updates is available, the print should be delivered within three (3) business days. All print products are to be delivered to the OCC Library, TBD location. 2.0 Delivery/Period Of Performance The Period of Performance (POP) for this requirement is 2/15/2017 through 12/31/2017. Also, the full text of a clause may be accessed electronically at: http://www.acquisition.gov FAR Clause Title Date 52.212-4 Contract Terms and Conditions - Commercial Items May 2015 FAR 52.212-1 INSTRUCTIONS TO OFFERORS COMMERCIAL ITEMS (OCT 2016) which is incorporated into the RFQ by reference, provides guidance on preparing and submitting quotes. Paragraph "(b) Submission of offers" of Clause 52.212-1 is replaced, in its entirety, by the guidance that follows in this section. The Request for Proposal (RFP) under solicitation number CC17HQR0035. All questions regarding the herein solicitation must be submitted January 18, 2017 11:00 AM, Eastern Time (ET). The offeror's quote in response to this RFQ shall be sent e-mail to D'Angela Moore dangela.moore@occ.treas.gov by January 24, 2017 9:00 AM, Eastern Time (ET). Quotes received after the above date and time will not be considered. Quote must be prepared in accordance with the instructions in this Part. Failure to completely comply with these instructions, in either format or content, may lead to the rejection of a proposal. • The Contractor shall provide a company Point of Contact including telephone number and email address who will be available to respond to any questions the Government may have. • The Contractor shall submit pricing based in accordance with instructions provided in the above. The quote shall: (1) Propose firm-fixed-prices for all CLINs specified in the RFQ. (2) Not deviate from the Government's requirement, product descriptions and quantities. Proposals that fail to address all solicitation requirements may be considered deficient or unacceptable and may be excluded from further evaluation. The Government does not intend to hold discussions. Therefore, the quote should contain the offerors' best terms from a technical and price standpoint. However, Government reserves the right to hold discussions at the sole discretion of the Contracting Officer. 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014) As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows: (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Factor 1: Technical Capability - The technical capability affords the offer the opportunity to explain its technical approach and experience that effectively and efficiently accomplishes the services specified in the Statement of Work (SOW). The Government intends to award to the lowest price technically acceptable offeror. Technical acceptability means offeror provides prices for all items listed in STATEMENT OF WORK, in the specified quantities and no substitutions. The Government will not accept compatible and/or remanufactured products. The Government anticipates awarding a single firm-fixed-price contract. Factor 2: Price - The offeror shall provide pricing in accordance with the Contract Line Item Number (CLIN) structures. The Government intends to award to the lowest price technically acceptable offeror. Technical acceptability means offeror provides prices for all items listed in PART I, in the specified quantities and no substitutions. Should any reference to such equipment or services appear in any news release or commercial advertising issued by or on behalf of the Contractor without the required consent, the Government shall consider institution of all remedies available under applicable law, including 31 U.S.C. 333, and this contract. Further, any violation of this provision may be considered during the evaluation of past performance in future competitively negotiated acquisitions. (End of clause) DTAR 1052.232-7003 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (APR 2015) (a) Definitions. As used in this clause- (1) "Payment request" means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), "Content of Invoices" and the applicable Payment clause included in this contract. (b) The Contractor shall not comply with any order, direction or request of Government personnel unless it is issued in writing and signed by the Contracting Officer (CO), or is pursuant to specific authority otherwise included as a part of this contract. (c) The CO is the only person authorized to approve changes in any of the requirements of this contract and notwithstanding provisions contained elsewhere in this contract, the said authority remains solely the CO's. In the event the Contractor effects any change at the direction of any person other than the CO, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in charges incurred as a result thereof. (End of Clause) 1052.237-8002 USE OF NON-GOVERNMENT PERSONNEL IN EVALUATION OF PROPOSALS OR QUOTATIONS (FEB 2014) (a) Offerors are hereby notified that non-government personnel will have access to the offerors' proposals.
