- The U.S. Army Corps of Engineers (USACE), Engineer Research and Development Center (ERDC), Construction Engineering Research Laboratory (CERL) intends to award a requirements contract for a five year ordering period on a sole source basis to Goda & Associates Inc. upon the basis of the authority provided at FAR 13.106-1(b)(1)(i). ERDC-CERL requires the microfluidic chips that are used in the operation of the On-Chip Biotechnologies Sort Microfluidic Flow Cytometer. This equipment uses the specialized microfluidic chips to prevent contamination of the instrument and the samples that are being analyzed. These chips make it so that there is no damage caused to the cells during the analysis in order to maintain cell viability, which is essential for subsequent experimentation after sorting processes. Substitution is undesirable since these specific chips are the only ones that can be used in the instrument. Goda & Associates, Inc. has been identified as the only source for the continued purchase of On-Chip brand equipment based on past procurement history as well as market research conducted via the internet, expert opinion, and contact with industry experts. The On-Chip Cytometer, including a starter batch of chips, was purchased by ERDC-CERL in March 2016 under a procurement advertised on FedBizOpps as a brand name requirement. On-Chip has two authorized distributors, Goda & Associates and Amuza. Under that procurement only Goda & Associates provided a quote due to the regional divisions of these companies (east coast vs west coast). The associated North American Industry Classification System (NAICS) code is 334516, which has a size standard of 1,000 employees. This is not a small business set aside, as this Notice of Intent is not a request for competitive quotations. However, interested parties may identify their interest and capability to respond to this requirement. Any interested party that believes they can fulfill this requirement should submit a capability statement to be reviewed. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government's acquisition strategy. Information received will be considered solely for determining whether to conduct a competitive procurement.
