- Applicable Provisions & Clauses Statement of Work FBO ANNOUNCEMENT: PRESOLICITATION NOTICE, NOTICE OF INTENT ACTION CODE: SPECIAL NOTICE CLASSIFICATION CODE: 70 - General Purpose Information Technology Equipment SUBJECT: Purchase of Customer Care Program for FreezerWorks' Sample Management Software SOLICITATION NUMBER: SB1341-17-NOI-01423 RESPONSE DATE: 10 days after posting DESCRIPTION: The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with DataWorks Development, Inc. (S), located at P.O. Box 174, Mountainlake Terrace, WA to purchase a Customer Care Program for FreezerWorks' Sample Management Software. The sole source justification is based on the following: The National Institute of Standards and Technology (NIST), Marine Environmental Specimen Bank (MESB) performs fundamental and applied research to advance and create state-of-the-art chemical measurement capabilities, theory and computational methods for quantitative measurements, and sensing of solids, liquids, gases, plasmas, transient species, and multicomponent matrices. MESB is located at NIST Charleston, Hollings Marine Laboratory in South Carolina, has utilized Freezerworks' sample management software for inventory control since 2010. Currently, the database being maintained on this software contains data and records for over 95,000 NIST samples, located in 36 freezers. Due to such volume, tracking the location of each sample is extremely important to ensure that each sample is accurately recorded and stored. This helps to enhance locating and accessing each sample and each sample's data more efficiently and effectively. Therefore, the purpose of this procurement is to purchase the Customer Care Package for FreezerWorks' Sample Management Software. Market Research indicates that there are other commercial companies who can provide software sufficient for maintaining the information that is currently being maintained by NIST's MESB. However, this procurement will be sole sourced to DataWorks Development, Inc. due to the feasibility of continuing to maintain and utilize the samples in the already existing software. If another company were chosen to fulfill this requirement, NIST would be required to abandon the current software to switch to an entirely new software, which would result in additional costs and time lost to transferring the data for the 95,000 samples that area already in inventory, and retraining of personnel on how to operate and maneuver through the new system. This process would easily require an effort of over one year to transition, would not result in any added value to the NIST, and would detrimentally impact the mission of MESB. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 511210 with a size standard of $3.85 million. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 11:59 pm EST 03/15/2017, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government.
