LIMITED SOURCES JUSTIFICATION FAR PART 8.405-6 Contact/Order Number: V797P-4285B / VA248-17-F-2353 This acquisition is conducted under the authority of the Multiple Award Schedule Program. The material or service listed in par. 3 below is sole source, therefore, consideration of the number of contractors required by FAR Subpart 8.4 Federal Supply Schedules, is precluded for the reasons indicated below. Restricted to the following source: Manufacturer/Contractor: Joerns LLC Mfgr/Contractor Address: 19748 Dearborn St Chatsworth CA 91311-6509 The requested material or service represents the minimum requirements of the Government. (1) AGENCY AND CONTRACTING ACTIVITY: Department of Veterans Affairs Network Contracting Office (NCO) 8 ___ 8875 Hidden River Pkwy_____________ Tampa, FL 33637-1075 VISN: 8 (2) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED: Logical Follow-on contract in accordance with FAR 8.405-6 (1)(i)(C). The manufacturer s Federal Supply Schedule is V797-4285B. The period of performance shall be one year. (a) A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY S NEED: Provide Bed and Mattress Rental Services to James A. Haley VA Medical Center from 1 April 2017 until 31 March 2018. The VAMC requires the following estimates: --- 500 Low Air Loss Mattress per month --- 90 Dolphin Mattresses per month --- 1 Enclosure Bed per month --- 15 Bariatric Lateral Turning Beds per day --- 45 Free Standing Bariatric Trapeze per month ---17 Bariatric Commodes per month (b) AWARD AMOUNT: $ 189,893.16 (c) PERIOD OF PERFORMANCE: 1 April 2017 until 31 March 2018 (4) IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE FAR 8.405-6), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE. The new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. In the interest of economy and efficiency, orders shall be issued against NAC FSS V797-4285B. The original solicitation for these supplies/services was competed with the resultant delivery/task order placed IAW applicable FSS ordering procedures. An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays. The Tampa VAMC s need for the supplies/services offered by the incumbent are of such an immediate need that the time that is required for a competitive solicitation and subsequent award would seriously damage the ability to treat patients. (5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.4 TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: In accordance with FAR 8.404(d), GSA has already been determined the prices on the schedule to be fair and reasonable. In addition, a price reduction was requested upon the issuance of the RFQ to the incumbent. The incumbent already has its equipment in place; therefore no transition or downtown is necessary. (6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: CO reviewed VIP and noted there were available veteran-owned businesses when a search was conducted using NAICS code 335119 with keyword hospital bed. A GSA Advantage search under SIN 65 II Category A-69 Beds and Mattresses for Medical Use displayed available veteran-owned businesses as well. Due to the urgent nature of this requirement, these companies were not solicited. (7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: The lease method is appropriate for Hospital Beds and support equipment because it is to the Government s advantage under the circumstances. Currently, the incumbent is meeting and/or exceeding the Government needs. The current contract expires 31 March 2017. The Tampa VAMC requires immediate use of the incumbent equipment to meet patient needs and VAMC goals. Currently, the Tampa VAMC does not support acquisition by purchase; the cost for purchase is drastically higher as indicated by lease vs purchase documentation (memo) that has been incorporated in the file in accordance with FAR 7.4. (8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: This is a non-competitive notice that: discloses award to the incumbent contractor, lists the items / description of items to be procured, and solicits other companies to submit their capability to offer identical or similar products/services to be considered for future acquisitions.
