Description
NEC Multi-Line Phones and Digital Line Card TAC-17-42931 2 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 Description of Action: This proposed action is for firm-fixed price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC) for NEC Multi-Line Phones and Digital Line Cards. Description of Supplies or Services: The Department of Veterans Affairs (VA), Office of Information Technology (OI&T), Region 3 has a requirement for NEC multi-line black telephones and 63 brand name NEC Multi-Line digital line cards with 16 ports to support an upgrade to the existing Private Branch Exchange (PBX) telecommunication system at the James A. Hale Veteran s Hospital (JAHVH) located in Tampa, Florida. Many of the phones at JAHVH are at end-of-life and can no longer be maintained by NEC through the existing maintenance agreement. Therefore, JAHVH requires new NEC multi-line black telephones and multi-line digital line cards that are compatible with the existing NEC PBX infrastructure in order to ensure the existing telecommunication system remains fully operational. Delivery shall be thirty (30) days after award. The total estimated price of the proposed action is $. Statutory Authority: The statutory authority permitting this exception to fair opportunity is Section 41 U.S.C 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) Section 16.505(b)(2)(i)(B) entitled, Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. Rationale Supporting Use of Authority Cited: Based on extensive market research, as described in Section 8 of this justification, it was determined that limited competition is available among authorized resellers for the required brand name NEC hardware. The required phones and line cards must be fully compatible with the existing NEC PBX infrastructure which consists of NEC components. Due to its proprietary nature, and specifically the routing and communication protocols that exist within the NEC PBX platform, only NEC brand phones and line cards are compatible and interoperable with the existing equipment. No other brand name phones and line cards will communicate and function within the existing NEC architectural design due to these proprietary constraints. Further, a replacement of the current NEC infrastructure would result in duplicative costs that would not be recovered through competition. Failing to upgrade the existing PBX system and equipment with the requested phones and line cards will hamper operational availability of the telecommunications network at JAHVH and ultimately compromise its provision of healthcare to Veterans. Based on the market research conducted by the Government technical experts, it has been determined only NEC phones and line cards can meet the Governments needs. Efforts to Obtain Competition: Market research was conducted, details of which are in Section 8 of this justification. Limited competition is anticipated for this brand name software maintenance support. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will be synopsized and the justification will be made publicly available on the Federal Business Opportunities Page within 14 days of award. Additionally, in accordance with Far 16.505 (a)(4)(ii)(A), this justification will be submitted to all applicable NASA SEWP V GWAC holders along with the Request for Quotation in order to fully notify all interested parties. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be fully competed. Market Research: The NEC phones and line cards are commercially available off-the-shelf hardware products currently in use in VA. When conducting market research in February 2017, the Government s technical experts reviewed phones and line cards available from other manufacturers to ascertain if these items could be implemented into the existing infrastructure at JAHVH. Specifically, the Government s technical experts conducted web-based research on similar hardware products available including Polycom, Avaya and Cisco. Based on the reviews, the Government's technical experts confirmed that only brand name NEC phones and line cards are compatible and interoperable with the existing NEC PBX components currently in use at JAHVH. Accordingly, only NEC phones and line cards from NEC or an authorized reseller can meet all the Government s requirements. The TAC conducted additional market research in April 2017 by utilizing the Provider Lookup Tool on the NASA SEWP V GWAC website, which found multiple contract holders that are resellers of NEC products, including 21 Vendor Information Page (VIP.gov) verified Service-Disabled Veteran-Owned Small Business (SDVOSB) GWAC contract holders. Additionally, NASA SEWP V GWAC has a dynamic catalog where line items can be added based on customer requests, therefore, as long as the required item or service is within scope of the NASA SEWP V GWACs, items and services can be added to a NASA SEWP V GWAC holder s catalog on a daily basis. Therefore, based on the results of the market research, there is reasonable expectation that sufficient competition exists among SDVOSBs in Group B(2) of NASA SEWP V. 9. Other Facts: None.
