Description
LIMITED SOURCE JUSTIFICATION EXCEPTION TO THE FAIR OPPORTUNITY PROCESS FAR 16.505(b)(2) 1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY: This is an exception to the fair opportunity process. The Naval Medical Logistics Command, acting on behalf of multiple Naval Medical Treatment Facilities (MTFs), intends to award a delivery order against the Defense Logistics Agency's (DLA Troop Support) Indefinite Delivery, Indefinite Quantity (IDIQ) contract SPM2Dl-09-D-8334. 2. NATURE/DESCRIPTION OF CONTRACT ACTION: The proposed action is to provide Hologic Selenia Dimensions radiographic mammography OEM-certified service training for eighteen (18) U.S. Navy biomedical equipment technicians (BMETs), on a sole-source basis from Hologic, Inc., 35 Crosby Drive, Bedford, MA 01730-1411, United States of America. The Government intends on awarding a Firm, Fixed-Price delivery order against the Defense Logistics Agency's (DLA Troop Support) Indefinite Delivery, Indefinite Quantity (IDIQ) contract SPM2D l-09-D-8334. 3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The Naval Medical Logistics Command (NMLC) has a requirement to provide Hologic Selenia Dimensions radiographic mammography OEM-certified service training for eighteen (18) United States Navy Biomedical Equipment Technicians (BMETs). If applicable, all prerequisites shall be identified and provided by the Contractor. The training provided shall afford Navy BMETs the ability to conduct first-look troubleshooting duties, preventive maintenance, and repair of all Hologic Selenia Dimensions radiographic mammography units at U.S. Naval Medical Treatment Facilities (MTFs). Course topics shall include, but not be limited to, the following: fundamentals of system operation, navigation of software graphic user interface (GUI), original equipment manufacturer (OEM) system design, procedural preventive maintenance, corrective maintenance, common user-errors, troubleshooting of common issues, and parts replacement. This training shall be identical to OEM training for contractor field service personnel. All root-level and/or administrative access passcodes shall be provided to the Navy BMETs. A copy of the official OEM service manual shall be given to each BMET, for his/her record. Should the OEM have any proprietary Test, Measurement, & Diagnostic Equipment (TMDE), which cannot be provided by any other distributor, this TMDE should be given to each Navy BMET, upon service training certification. The Contractor shall instruct the eighteen (I 8) BMETs on servicing equipment within the parameters of OEM specifications, in accordance with all US, State, and Local law and regulations, U.S. Navy regulations, U.S. Navy instructions, and Joint Commission requirements. The Joint Commission's requirements are specified in its Comprehensive Accreditation Manual for Hospitals (CAMH), readily found on jointcommission.org. U.S. Navy regulations and instructions will be made available upon request. Specific BMETs, to attend the training, will be identified upon award. Course scheduling shall be initiated upon award and finalized in no later than 90 days. All BMET service training shall be completed within the same U.S. Government fiscal year, as associated fiscal year of funding. NMLC shall have the option to send the Navy BMETs to training in groups. NMLC shall have the ability to mandate the specific calendar days on which the Navy BMETs attend the service training. Location of the service training shall be determined by the contractor. The contractor shall have the option to conduct training courses on-site at various Naval MTFs, upon coordination with NMLC. If training is to be conducted at a vendor's facility, prerequisite courses shall be offered directly prior to the Hologic Selenia Dimensions service training course. Thus, the Navy BMETs will only require one instance of travel to the vendor's training facility. The contractor shall grade the class performance of each Navy BMET. Upon satisfactory completion of OEM-certified service training, the Navy BMET shall receive an OEM service training completion certificate. The certificate shall include, but not be limited to, the following information: Student Name, Course Director Name, Course Title, Associated Equipment Make & Model, OEM-authorizing Personnel Signature, and Date of Course Completion. The contractor shall deliver a copy of each official certificate to the COR and Technical Liaison, no later than 30 days after course completion by each Navy BMET. The vendor shall have official OEM authorization to conduct service training for the Hologic Selenia Dimensions radiographic mammography system. Satisfactory completion of the service training shall mandate that the OEM recognize the Navy BMET as an OEM-authorized service provider of the Hologic Selenia Dimensions radiographic mammography system. All service training courses associated with the equipment/system shall be in accordance with the OEM terms and conditions. Navy Operation and Maintenance Fiscal Year 2017 funds in the amount of $216,000.00 will be used for this acguisition. 4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION OF CONTRACTOR'S UNIQUE QUALIFICAITONS: The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(]) and FAR 16.505(b)(2)(ii), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies ordered are unique or highly specialized. Hologic, Inc. is the only vendor that can provide original equipment manufacturer (OEM) certified training on Hologic radiographic mammography systems equipment, specifically the Selenia Dimensions. Hologic authoriz s no third party companies to conduct official BMET Selenia Dimensions service training. Only training offered by Hologic will authorize Navy BMETs to conduct official preventive and corrective services on existing, Government-owned Hologic radiographic mammography systems. Awarding a contract to a vendor other than the OEM would not give the Navy continued reduction in annual service costs, negating the purpose of sending Navy BMETs to training. Thus, no other contractor can provide OEM service training on the required equipment. 5. DETERMINATION OF BEST VALUE: On the existing IDIQ, DLA has determined the prices of offerings to be fair and reasonable. The Contracting Officer shall make a determination of best value for the Government before a delivery order is executed. 6. DESCRIPTION OF MARKET RESEARCH: Market research was conducted in June 2016. It included a search of the Internet using Google, Yahoo, Bing, GSA Advantage, EDA, ECRI, and contacting subject matter experts. GE, Philips, Siemens, Toshiba, Fuji, and Radiological Service Training Institute (RSTI) offer radiographic mammography unit training. GE, Siemens, Toshiba, and Fuji offer training specific to their manufactured mammography systems and not the Selenia Dimensions. Thus, GE, Siemens, Toshiba, and Fuji do not meet the minimum requirements of the Government. Philips and RSTI offer Hologic Selenia Dimensions model-specific service training, although not available on any existing Government contracts. Philips' and RSTI's courses are not validated by the OEM quality control process; Hologic does not recognize their service training as OEM­ authorized courses. Upon registration in any OEM Hologic BMET service training course, an attendee must sign a non-disclosure agreement (NDA). Therefore, if any Field Engineers working for Philips or RSTI were to teach the information learned in a Hologic course, they would be in violation of that signed NDA. If service training courses were procured from a non-OEM-authorized source, annual service contract savings would not be available. No contractor, aside from Hologic, can offer OEM­ certified service training for the Hologic Selenia Dimensions radiographic mammography unit. Hologic, Inc. is the only vendor that can provide the required training. 7. ANY OTHER SUPPORTING FACTS: None. 8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: Future procurements will be done in accordance with FAR 16.505. 9.
