- LIMITED SOURCES JUSTIFICATION ORDER >$150,000 FAR PART 8.405-6 Acquisition Plan Action ID: VA246-17-AP-9332 This acquisition is conducted under the authority of the Multiple Award Schedule Program. The material or service listed in paragraph 3 below is sole source; therefore, consideration of the number of contractors required by FAR Subpart 8.4 Federal Supply Schedules, is precluded for the reasons indicated below. Restricted to the following source: Manufacturer/Contractor: Leica Incorporated (OEM), Government Scientific Source Inc. (distributor) Manufacturer/Contractor POC & phone number: Annette Cheltenham/800-248-8030 Mfgr/Contractor Address: 12351 Sunrise Valley Drive, Reston, VA 20191 Dealer/Rep address/phone number: Same as above The requested material or service represents the minimum requirements of the Government. (1) AGENCY AND CONTRACTING ACTIVITY: Department of Veterans Affairs Network Contracting Office 6 100 Emancipation Drive, Bldg. 27 Hampton, VA 23667 VISN: 6 (2) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED: The objective of this request is to procure Leica brand Model ASP6025 Tissue Processor by means Other Than Full and Open Competition. Delivery shall be to the VA Medical Center, 1601 Brenner Avenue, Salisbury, North Carolina 28144. A new contract, firm-fixed-priced, is planned for this one-time equipment procurement. This award will be made to Government Scientific Source Inc. (a Veteran-Owned Small Business concern) under their GSA Schedule GS-07F-5934R. (3) (a) A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY S NEED: VA Medical Center at Salisbury, North Carolina requires additional tissue processing equipment of the same brand and specifications, compatible with the existing equipment to meet increased workload demands. (b) ESTIMATED DOLLAR VALUE: $221,728.40 (c) REQUIRED DELIVERY DATE: August 30, 2017 (4) IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE FAR 8.405-6), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE. - Specific characteristics of the material or service that limit the availability to a sole source (unique features, function of the item, etc.). Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources. Salisbury VAMC requires the same brand equipment that is in use as a cost saving measure to eliminate the need for equipment management and training endeavors for two different makes/models of equipment. Government Scientific Source, Inc. is the only authorized distributor of the required brand name equipment. - The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system. The additional equipment must be exact in order to utilize the existing tissue media and to ensure consistent testing results. (5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.4 TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: - This Limited Justification represents the best value to the Government as the pricing is pre-determined as fair and reasonable. A competitive procurement would also duplicate administrative costs which are not likely to be recovered as additional stock media would be required in the event a different model of processor being introduced. Education and training efforts would also be required in support of competing for another brand/model of processor. (6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: - Internet searches of FPDS, FBO, and DSBS indicate the required equipment is readily available through sufficient commercial sources. A search at VetBiz for NAICS 334516 provided 53 potential Service-Disabled/Veteran-Owned Small Business (SD/VOSB) entries, but providers of tissue processing equipment is not evident in these results. An additional search of GSA schedule holders under NAICS 334516 provided two Veteran Owned Small Businesses under Schedule 66, SIN 603 7 Laboratory Instruments; however, only one vendor (Government Scientific Source Incorporated) can provide the required brand name product under their GSA contract GS-07F-5934R. As such, the Rule of Two requirement cannot be met to support a competitive procurement. ALL SIGNATURES REDACTED. DJH.
