Description

DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition Contracting Activity: The Department of Veterans Affairs Network Contracting Office 6, on behalf of the VA Medical Center in Salisbury, North Carolina, intends to procure for the provision and installation of security cameras, under procurement request 659-17-3-6048-0044. Nature and/or Description of the Action Being Processed: The objective of this Justification is to procure by means Other than Full and Open Competition for the required security camera system, which shall be compatible with the existing Genetec ® band server. Place of performance is the VA Medical Center in Salisbury, North Carolina (VAMC). A new contract, firm-fixed-priced, is planned for this one-time equipment and installation procurement. This procurement for the stated equipment is in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. Description of Supplies/Services Required to Meet the Agency s Needs: The VA Medical Center at Salisbury, North Carolina is currently planning the opening of a newly constructed parking structure and requires the security camera system to be in place prior to opening. The estimated value of this procurement is $. Award will be made to Tar Heel Communications, a Small Business concern, at 240 Foxwood Lane, Salisbury, North Carolina 28147. Statutory Authority Permitting Other than Full and Open Competition (Brand Name Descriptions): (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented for restricting competition on this procurement via FAR 13.106-1 (b)(2). Demonstration that the Contractor s unique qualifications is required for the procurement (FAR 6.302-1(c): The new security camera system will be integrated with the existing system, and a certified, licensed electrician familiar with the existing system is required. Tar Heel Communications is certified and licensed to work within an existing Genetec server at the Medical Center. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research in accordance with FAR 10.002 requirements indicated sufficient sources were available, however, no responses to the published solicitation were received. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The estimated cost can be considered fair and reasonable based on comparison with the Independent Government Cost Estimate and historical procurements for the same or similar equipment at the Salisbury VA Medical Center, as well as other VISN 6 sites of care. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Internet searches, including those of FPDS, FBO, and DSBS were conducted to determine capable providers. Additionally, a search of NAICS 238210 at VetBiz.gov provided 1107 SD/VSOB entries. However, while the determination of contractors capability to work within the Genetec system not evident in the search, it was reasonable there would be two or more capable vendors with the results received. Any Other Facts Supporting the Use of Other than Full and Open Competition: There are no other facts supporting this Justification other than those previously stated. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No sources expressed written interest in the acquisition as market research was sufficient in identifying potential sources, and further communication with industry was not required. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There are no barriers to competition as a competitive procurement was published, however, with no responses.
