Description
This action has been awarded to Santa Ana Pueblo. 5.0 SPECIFIC TASKS: 5.1 The purpose of this contract is to assist the Corps in fulfilling federal cultural resources management and stewardship responsibilities, and Section 106 compliance for the proposed Tamaya Drainage Project prior to and during construction activities. This contract for cultural resources assistance to the Corps will help to avoid effects to the ancestral Tamaya Village or other cultural resources that may be located in the immediate vicinity of the construction area. 5.1.1 All work conducted must follow and shall be in compliance with Federal, Tribal, and State cultural resources laws and regulations, Executive Orders, and U.S. Army Corps of Engineers Regulations; including the National Historic Preservation Act (NHPA) of 1966 (PL 89-665 et seq.), National Environmental Policy Act (NEPA) of 1969 (PL 90-190), Native American Graves Protection and Repatriation Act (NAGPRA) of 1990 (PL 101-601), and Executive Order 13007 (Indian Sacred Sites, 24 May 1996). The standards and methods used during the project shall adhere to the requirements of the New Mexico Administrative Code, Title 4, Cultural Resources. 5.2 The Pueblo shall provide a Tribal Cultural Resources Advisor to serve as a point of contact for the Corps' Project Manager for Tamaya Drainage construction, and appropriate Pueblo officials (cultural, governmental, and religious) for activities outlined in this contract. The Tribal Cultural Resources Advisor may assign other tribal members or employees to act as the tribal representative or supporting team to conduct activities at the construction site. 5.3 The Pueblo shall provide services to assist Corps' project management during the Tamaya Drainage Project construction with coordination in the conduct of the project; collection and collation of photographic records prior to construction and vibration monitoring reports during construction; as well as monitoring construction activities in the event of a discovery of unknown cultural resources that may be located within the project construction area. 5.4 Pueblo services shall include but not be limited to the following: 5.4.1 The Tribal Cultural Resources Advisor shall serve as a single point of contact and liaison between the Pueblo and the Corps' Construction Representative or authorized representative for all work required under this contract. The Tribal Cultural Resources Advisor shall be responsible for the complete coordination of all work developed under this contract. The Tribal Cultural Resources Advisor and supporting team shall consult with the Corps' Project Manager concerning the methodology and procedures of each proposed construction activity to insure that the Corps' and the Pueblo's best interests are served and all of the objectives of the proposed work are met in a timely manner. 5.4.1.1 The Tribal Cultural Resources Advisor or other designated Tribal representative shall attend all weekly project team meetings and other coordination meetings with the Corps' Construction Representative. Meetings may be held at a location and time mutually agreeable to the Tribal Cultural Resources Advisor, the Project Manager and the Construction Representative to review the progress of work to be performed under the terms of this contract. No formal meetings are scheduled at this time. 5.4.2 The Tribal Cultural Resources Advisor shall conduct consultations with individuals or groups in the Pueblo with special knowledge of the Tribal concerns regarding cultural resources that may be associated with the proposed project area to identify any physical features or cultural practices that may be affected by the proposed project. 5.4.3 The Tribal Cultural Resources Advisor shall assist the Corps' Project Manager with the identification of areas adjacent to the construction area to avoid during construction, and assist the Corps contractor for the Tamaya Drainage Project with the collection of and collation of pre-construction photographic records and vibration monitoring records during construction. These records shall be retained by the Pueblo through the completion of the project. 5.4.4 The Tribal Cultural Resources Advisor shall report information regarding potential conflicts between the Corps' proposed activities and the Pueblo's concerns to the Corps' Project Manager, and provide assistance in avoiding negative impacts and/or provide viable alternatives. 5.4.4.1 In the event the Tribal Cultural Resources Advisor encounters difficulty in meeting performance requirements, or when he/she anticipates difficulty in complying with the contract delivery schedule or date, or whenever the Tribal Cultural Resources Advisor has knowledge that any actual or potential situation that may result in delaying or threatening to delay the timely performance of this contract, the Pueblo's Tribal Cultural Resources Advisor shall immediately notify the Corps' Contracting Officer in writing, giving pertinent details; provided however, that these data shall be informational only in character and that this provision shall not be construed as a waiver by the Corps of any delivery schedule or date {or of any rights or remedies provided by law or under this contract}. 5.4.5 The Director, Pueblo of Santa Ana Department of Natural Resources, or his delegate, shall coordinate all proposals, access requests, and needed permits with the Pueblo government. Copies of pertinent permits shall be provided to the Corps' Project Manager as soon as they are received. 5.4.6 The Tribal Cultural Resources Advisor shall provide weekly progress reports summarizing the results of work performed under this contract in an organized narrative format. All narrative shall be done in a format that is compatible with Microsoft Word 2013, or Portable Delivery Format (PDF). 5.4.6.1 Progress Reports. Weekly progress reports shall be submitted directly to the Corps' Project Manager by electronic mail. These reports shall include an accurate quantitative and qualitative accounting of overall progress on the project worked on during the reporting period. A discussion of any current or anticipated problems that may impede performance, and proposed corrective measures. A discussion of the work to be performed during the next reporting period. 5.4.6.2 Weekly progress reports shall be in 8½" x 11" format. The Pueblo shall provide all text documents in Microsoft Word 2013 or PDF format. If other documentation is provided: all graphic files shall be in TIFF and JPEG format, all photographs in JPEG format, all database files in Microsoft Excel or Access format, and all ArcGIS files used to create the report shall be provided on a CD/DVD. 5.4.7 The Contract Manager shall be responsible for the administration of this Performance Work Statement. The Contract Manager shall document hours worked and prepare and submit statements for payment. 5.5 PAYMENT SCHEDULE. For all work accomplished during the Tamaya Drainage Project, partial payments shall be made based on the project actual hours worked completed. Billing shall be no more frequently than once every two weeks and shall be based on the numbers of meetings and other activities performed during the billing period. The Pueblo's Tribal Cultural Resources Advisor shall submit an original and one copy of the invoices detailing the work accomplished.
