- Justification for Other than Full and Open Competition (JOFOC) Justification for Other than Full and Open Competition (JOFOC) Contracting Action: SGB50017C0005 1.Identification of Agency/Contracting Entity FAC Section / US Embassy Libreville. 2.Nature and/or Description of Action to be Approved Waste Water Treatment Plant BME ($50,096.00). 3.Description of Supplies or Services Required Arrange a BME contract of Waste Water Treatment Plant (with JET INC). 4.Identification of Statutory Authority Permitting Other than Full and Open Competition 10 U.S.C. 2304(c)(2) or 41 U.S.C. 253 © (2), Unusual and compelling urgency, as implemented by FAR by FAR 6.302-2. 41 U.S.C 3304 (a)(1):; Only one responsible source and no other services will satisfy agency requirements because existing system and upgrades required have been sourced by Jet Inc. The Waste Water Treatment Plant is currently in a rapid state of decline effecting reliability, functionality and safety of Post's Waste Water Treatment Plant potentially exposing post to unnecessary health and safety risks. 5.Reason for Cited Authority Jet, Inc. is the only company with the requisite set of knowledge skills and experience needed to perform the work in the required time frame. They have unique knowledge of the proprietary programing and configuration of the system, and, because the system is composed of proprietary parts, is the only source of these parts. By proceeding to contract award, the USG eliminates delay and additional expense associated with contracting and ensures that the plant will be properly serviced. Post is no longer able to purchase chlorine tablets for its WWTP as the product is highly hazardous. Without an immediate action, the waste water treatment process will become completely inoperative within few months. 6.Efforts to Obtain Competition An open solicitation for these services is not recommended since circumstances appear to preclude competition. The requirement will be synopsized as required by FAR 6.302-1(d)(2) and statements of capability considered before determining whether to proceed to award on a sole-source basis. 7.Determination of Fair and Reasonable Cost The Contractors cost proposal will be evaluated against an Independent Government Estimate (IGE) to determine if it is fair and reasonable value to the Government. 8.Market Research A market survey was not conducted in support of this request due to the urgent and compelling nature of the request. Jet Inc., has been intimately involved in the project since its inception, providing the firm with unique qualifications and superior knowledge of the project program and requirements, site features and constraints as well as the design 9.Additional Supporting Facts The Government has a short time frame for commencement of the design, manufacturing and maintenance of the water treatment equipment to deploy measures to ensure the Waste Water Treatment Plant has been restored to safe and reliable operation. This sole source award will benefit the Government and facilitate Mission readiness. 10.Interested Sources No other sources have been contacted due to the nature of the requirement. 11.Proposed Actions to Overcome Barriers to Competition Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.) The intent to acquire the services described herein from a sole source will be published on FedBizOps in accordance with FAR 6.302-1(d)(2). Offers or statements of competence from potential alternatives will be evaluated. This J & A or a revision thereof will be published within 14 days after award if award on a sole-source basis is made.
