Contracting Activity: Mission and Installation Contracting Command (MICC) - Fort Gordon, GA. 2. Description of Action: Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B). Description of Services or Supplies: The Defense Forensic Science Center (DFSC) requests the sole source purchase of the Illumina Care Advantage Plan to perform routine maintenance and repair of the Illumina MiSeq FGx, NextSeq 500 instruments and the FGx Server. Total Dollar Value: $248,700.28 Period of Performance: 29 July 2017 - 28 July 2020 4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5: Unusual and compelling urgency Exclusive licensing agreements Industrial mobilization Other: Sole Source 5. Reasons for Authority Cited: a. The Defense Forensic Science Center (DFSC) located at the Gillem Enclave in Georgia provides forensic laboratory services to the Department of Defense investigative agencies and other Federal law enforcement agencies. DFSC's Research, Development, Test and Evaluation program -1- Control # Gordon-2017-10 (RDT&E) under the Office of the Chief Scientist requires the Illumina Advantage Plan to support forensic laboratory accreditation compliance of installed Illumina instruments and equipment. (ISO 17025 ANSI-ASQ National Accreditation Board). b. Illumina is the manufacturer of the equipment and is the only authorized source to offer extended warranty services for such equipment within the United States. The use of Illumina's systems, kits and proprietary accessories are required to assure the continuity and integrity of research data that have already been accumulated using the Illumina NGS platform. An award to any other vendor or manufacture of an NGS instrument and associated accessories for maintenance of Illumina systems would be in violation of proprietary agreements, and would compromise the research, invalidate existing test results and significantly delay DFSC NGS validation studies. This innovative research is relevant to the Army efforts to investigate and solve sexual assault cases. c. No other instrument in DFSC OCS's possession can perform the type of analysis this instrument provides if this instrument is out of service. Regular preventive maintenance helps to maintain the high standards of accuracy and precision, as well as minimizing instrument downtime. Also regular maintenance can help to increase the lifespan and productivity of the instrument. d. Impact. When the Illumina instruments fail without a service contract, DFSC OCS will not receive priority support to obtain the parts or get them installed. The cost of parts and service will be much higher than an annual contract price and require the acquisition of a new contract for service at the time of the instrument failure. Since acquiring new contracts can take months, the instrument will be out of service for extended periods of time and analysis will cease during that downtime. Scientists in OCS are not authorized or trained to perform maintenance on this instrument. 6. Efforts to Obtain Competition: To promote competition the MICC-Fort Gordon will continue to synopsize and conduct market research to ensure there are other vendors that can provide the requirement. MICC-Fort Gordon will continue to verify that the equipment are still proprietary to Illumina, Inc. A sources sought was posted and no responses were received. The vendor provided a proprietary letter. 7. Actions to Increase Competition: DFSC research scientists are continually researching sources of information and services to enable forensic examiners to conduct effective and reliable examinations. Market research consists of internet research, literature reviews, discussions with vendors, and other professional resources attending forensic science and technical conferences and industry events. If DFSC identifies a similar requirement, every effort will be made to compete it to the maximum extent possible. To increase competition the MICC-Fort Gordon will continue to synopsize and conduct market research to ensure there are other vendors that can provide the requirement. The Government will issue a sole source synopsis and address any responses accordingly. 8. Market Research: Extensive research was conducted (Internet searches, telephonic communications, forensic conference exhibits, electronic communications, and literature searches) to determine the availability of service support for Illumina instruments. Market Research was conducted on the General Services Administration (GSA) Advantage web site and the internet to determine if this service is available through Federal Supply Schedules or open market. There are -2- Control # Gordon-2017-10 no GSA vendors or alternative authorized distributors of this product. Illumina has confirmed by letter that they are the only authorized distributor and service provider of this specific product. The Government will issue a sole source synopsis and address any responses accordingly. The vendor provided a proprietary letter.
