Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the contracting activity. This justification is executed by the Naval Medical Logistics Command (NMLC), Fort Detrick, MD, on behalf of the Navy to meet the requirements of United States Naval Hospital (USNH) Guam. 2. Nature and/or description of the action. The proposed action is for the filling of Government owned cylinders with medical grade cylinder gases, furnish medical solids, for cylinder testing and maintenance and delivery/pick-up services in support of medical missions/operations to the USNH Guam and its supported activities.. The Government intends on awarding a Firm Fixed Price (FFP) contract. The proposed vendor is Marianas Gas Corporation dba Island Equipment Gas, Unit A, 151 West Harmon Industrial Park Road, Tamuning, Guam. 3. Description of the supplies/services required. USNH Guam and its supported activities have the requirement for the filling of Government owned cylinders with medical grade cylinder gases, furnish medical solids, for cylinder testing and maintenance and delivery/pick-up services in support of medical missions/operations to the. Products consist of compressed Medical Air USP, Oxygen USP, Carbon Dioxide USP, Nitrogen NF, Nitrous Oxide USP, Helium USP, Lung Diffusion Mixtures, Liquid Oxygen, and Dry Ice. On a regular basis the vendor is required to deliver filled cylinders and pick-up empty cylinders within seven (7) days and provide delivery of gases within 24 hours, when necessary. This service is an on-going requirement. One (1) base and four (4) option years are needed with a total estimated cost of $[redacted]. DHP O&M funds in the amount of $[redacted] have been received for the base year. 4. Identification of the statutory exceptions permitting other than full and open competition. The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1), FAR 13.106-1(b)(2), soliciting from a single source. There is only one vendor capable of providing the medical gas products and services that meet the government requirements. 5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. There are various types of medical grade liquefied and solid gases utilized for patient care. On the island of Guam, there is limited access to various goods and services due to USNH Guam's distance from the mainland. Because of the isolated location no other vendor would be able to meet the timeliness of deliveries needed to support the medical mission. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable. Market research was performed, the results of which are in paragraph 8. This requirement will be posted to FedBizOpps in accordance with FAR 5.201. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the vendor's commercial price list and will be determined fair and reasonable. 8. Description of the market survey conducted and the results, or statement of the reasons a market survey was not conducted. Market research was conducted in June and July of 2017. The market research conducted included a search of previous procurements, the Internet using Google and GSA Advantage. During the 2016 acquisition of these services market research indicated that a sources sought notice was issued in August of 2015 timeframe that indicated that at least 2 sources may be capable of meeting the needs of the Government. The 2016 a solicitation was posted on FBO from 20 July 2016 to 22 August 2016 with only one offer received that from Island Equipment Gas. Further email inquiry in July 2017 to gas companies in Guam either garnered no response or a response that referred to Island Equipment Gas as the only source on Guam for these products and services. Additionally, USNH Guam also reached out the other hospitals and medical facilities for their source to which they referred to Island Equipment Gas. Island Equipment Gas is the only source that provides all the medical graded liquefied/solid gases to the surrounding hospitals and medical facilities. 9. Other facts supporting the use of other than full and open competition. None 10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition. To date, no other sources have written to express an interest. This requirement will be posted on FedBizOpps in accordance with FAR 5.201. Any sources expressing interest in response to the synopsis will receive consideration. 11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Future requirements will be synopsized in accordance with FAR 5.203. 12.
