- Justification for Other than Full and Open Competition-PR0011441 PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE PUBLISHED. The Federal Bureau of Investigation (FBI) intends to negotiate a one-time, sole source, fixed price contract with Thermo Electron North America, 5225 Verona Road Bldg 1, Madison, WI, 53711-4497, for the purpose of procuring an annual service and maintenance agreement for its existing LTQ Orbitrap XL System. The FBI, Laboratory Division requires an annual service and maintenance agreement for its existing LTQ Orbitrap XL System to include priority status for technical support inquiries, unlimited on-site service, one Preventative Maintenance visit, software updates and notifications, engineer labor and travel included, factory-certified replacement parts and a subscription to e-Support Online Technical Resources. The service and maintenance must be performed by an authorized, factory-trained engineer. Based on market research, and Government end-users, it has been determined that Thermo Electron North America is the sole owner and manufacturer of the LTQ Orbitrap XL System and the only source capable of providing the required service, preventative maintenance and proprietary and copyrighted operating software upgrades to the existing LTQ Orbitrap XL System. This notice will be distributed solely through the General Services Administration's Federal Business Opportunities (FBO) Website (www.fedbizopps.gov). Interested parties are responsible for monitoring the FBO site to ensure they have the most up-to-date information about this acquisition. The North American Classification System Code is 811219, Other Electronic and Precision Equipment Repair and Maintenance.. The FBI intends to negotiate with only one source under the authority of FAR 6.302-1. Emailed responses will only be considered. Information received will be considered solely for the purpose of determining whether or not to conduct a competitive procurement. A determination by the Government not to compete this proposed contract based upon responses to this notice is at the discretion of the Government. Vendors must be registered in SAM, effective July 29, 2012 to receive government contracts. The FBI uses a financial system that has a direct interface with SAM. Please ensure that your company's SAM information is updated and accurate. This includes TIN, EFT, DUNS, addresses and contact information. The EFT banking information on file in SAM will be what the FBI uses to process payment to your organization.
