VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP Attachment 2: Request for Sole Source Justification Format > $150K VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID:__VA250-18-AP-2277______ Contracting Activity: Department of Veterans Affairs, VISN 10, Aleda E. Lutz VA Medical Center, 1500 Weiss Street, Saginaw, Michigan 48602. The 2237 number is 655-18-2-921-0005. Nature and/or Description of the Action Being Processed: This is a request for a sole source for a firm-fixed price bridge contract to Mobile Medical Response, Inc. (834 South Washington, Saginaw, Michigan, 48601; (989) 758-2900) for 24 hour ambulance services for beneficiaries of the Aleda E. Lutz VA Medical Center. FAR 13.5 Simplified Procedures for Certain Commercial Items: In accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. Description of Supplies/Services Required to Meet the Agency s Needs: Mobile Medical Response, Inc. will provide 24 hour Basic Life Support (BLS) Ambulance Service and Advanced Cardiovascular Life Support (ACLS) in accordance with local, state, and federal laws for beneficiaries of the Aleda E. Lutz VA Medical Center, 1500 Weiss Street, Saginaw, Michigan, for the time period of January 16, 2018 May 31, 2018. The contractor shall perform required services in accordance with the standards of the Commission on Accreditation of Ambulance Services (CAAS). Statutory Authority Permitting Other than Full and Open Competition: (x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2). Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Mobile Medical Response, Inc. currently provides these services to the Aleda E. Lutz VA Medical Center under contract VA251-13-D-0029, which expires January 15, 2018. The end user did not submit the appropriate documentation for a follow-on contract until November 29, 2018. This does not provide ample time to compete and negotiate a short-term contract, as the procurement lead time for a competitive contract of its estimated dollar value is 153 days. Furthermore, even if this requirement were competed in this short timeframe, it is not enough time to get a new contractor established. Prior to commencing work, a new contractor would need to meet various requirements, including the inspection of their facility and all vehicles intended for use under this contract prior to beginning work. As such, a sole source bridge is being sought for the time period of January 16 May 31, 2018 so that a new five-year contract can be competed and put in place. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought notice was issued on FBO on December 1, 2017 (36C25018Q0170). At the time the notice expired on December 5, 2017 at 12:00 Eastern, no responses were received. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost to the Government is expected to be fair and reasonable through price comparison with the prior contract with Mobile Medical Response, Inc. for identical services provided from 2013-present (VA251-13-D-0029). The IGCE submitted reflects the current price bring paid for these services, and the price quotation to be received from Mobile Market Response, Inc. will be analyzed and compared with the price of services provided in the past. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A sources sought notice was issued on FBO on December 1, 2017 (36C25018Q0170). At the time the notice expired on December 5, 2017 at 12:00pm Eastern, no responses were received. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The VA will research the market again as a contract for ambulance services beginning June 1, 2018 is pursued.
