REQUEST FOR INFORMATION QUESTIONNAIRE APPENDICES LIST OF CHIP-IN ACT ELIGIBLE PROJECTS PUBLIC LAW 114-294 7 8 16 16 OVERVIEW The U.S. Department of Veterans Affairs (VA or Government) is considering new approaches to leverage existing assets and engage the private sector to strengthen its ability to provide access to Veterans. VA is also referred to in this Request for Information (RFI) as the Government. Public Law 114-294, the Communities Helping Invest through Property and Improvements Needed for Veterans Act of 2016, also known as the CHIP IN Act, authorizes VA to carry out a pilot program, under which it may accept up to four more donations from specified non-federal entities of: (1) real property that includes a constructed facility or that is to be used as the site of a facility constructed by the donor, and (2) a facility to be constructed by the donor on VA-controlled property. A copy of the CHIP In Act is attached in Appendix B below. VA's authority to accept donations under the program expires on December 16, 2021. This RFI seeks interest from non-federal entities for participation in this pilot program. Such entities include state or local authorities; 501(c)(3) non-profit corporations; limited liability corporations; private entities; a donor or donor group; and any other non-Federal entities. The potential opportunities that are the subject of this RFI are located throughout the country across VA s five districts, and are divided in to three categories: 1) Primary Care & Mental Health 2) Inpatient & Long-Term Care and 3) Research. Each potential project and relevant property location is briefly described in Appendix A of this RFI. These projects present opportunities for capital projects that will enhance access to healthcare and services for Veterans. Through this RFI, the Government is seeking potential strategic partnerships to increase access to veteran-focused healthcare and services. This notably includes instances where VA lacks the funds or is facing a funding gap to establish needed facilities to provide state-of-the-art healthcare and services to our nation s Veterans. The Government's key strategic objectives related to the optimization of the Properties include the following: Increase access to high quality healthcare and services for Veterans; Enhance existing owned infrastructure or acquire replacement turnkey facilities to meet VA mission needs; Leverage the expertise of the real estate industry to optimize the scope of capital projects; Maximize financial return and qualitative benefits to Veterans, the government and taxpayers; and Minimize impact on operations and avoid need for any swing space or temporary relocation of operations. VA facilities constructed pursuant to the CHIP IN Act shall conform to design, construction, and physical security standards established jointly by VA and the selected partner. Those standards will take VA s use of the facility into account as well as the criteria and standards established through a risk assessment of the facility. The Government is issuing this RFI to obtain responses from real estate developers, institutional landholders, construction entities, joint ventures, and other members of the development community (Respondents) who are potentially interested in partnering with VA to enhance or redevelop the Properties in accordance with the CHIP IN Act framework. The Government will use the information provided for planning purposes and for making strategic decisions regarding the future use of the Property. The Government will not enter into an agreement as a result of responses to this RFI. After review of the responses, the Government will determine if there is the breadth and depth of interest from Respondents to proceed with further discussions. The Government reserves the right to consider, explore, and pursue donation projects under the CHIP IN Act, outside of and regardless of whether such donors respond to this RFI. The Government will not reimburse Respondents for any expenses associated with responding to this RFI. DESCRIPTION OF OPPORTUNITIES A list of projects eligible for partnership opportunities under the CHIP-IN Act can be found in Appendix A this RFI. Additional information regarding the aforementioned opportunities can be obtained by sending an email request to RPSU@va.gov. POSSIBLE DONATION STRUCTURES Some of the planned VA capital projects described in Appendix A, which reflect potential donation opportunities to VA, have received certain levels of congressional appropriations. However, some of them have not received any such funding to date. Accordingly, interested parties should take care to note whether any projects listed, for which they may be interested in proposing a donation concept to VA under the CHIP IN Act, has received funding or not. National Historic Preservation Act The National Historic Preservation Act, 16 U.S.C. § § 470, et seq. ( NHPA ) requires Federal agencies to consider effects on historic properties. Section 106 of the NHPA specifically requires a Federal agency to seek ways to avoid, minimize, or mitigate adverse effects (e.g., demolition) that the project might have on historic properties. Early in the project planning process, the Respondent will begin compliance activities pursuant to the NHPA. VA will act in concert with the Respondent in the accomplishment of historical compliance. Prior to finalizing design for the proposed partnership, the Respondent must ensure requirements of the NHPA are completed and the Section 106 consultation process, if required, has concluded with the execution of a Memorandum of Agreement or Programmatic Agreement. All required studies, reports, updates, site assessments and other compliance activities will be the responsibility of the Respondent. Environmental & National Environmental Policy Act The project will be subject to all applicable federal, state, and local environmental laws, codes, ordinances, and regulations, including but not limited to, the Comprehensive Environmental Response, Compensation, and Liability Act ( CERCLA ), 42 U.S.C. § § 9601-9675; the Resource Conservation and Recovery Act ( RCRA ), 42 U.S.C. § § 6901, et seq.; and the National Environmental Policy Act ( NEPA ), 42 U.S.C. § § 4321-4347. NEPA requires that federal agencies identify and evaluate the environmental impacts of their actions. Early in the project planning process, the Respondent will begin compliance activities pursuant to the NEPA. VA will act in concert with the Respondent in the accomplishment of the NEPA compliance. Prior to finalizing design for the proposed partnership, the Respondent must ensure requirements of the NEPA are completed. Completion of NEPA is evidence by VA s completion of a Categorical Exclusion, or publication of a Finding of No Significant Impact or Record of Decision. All required environmental studies, reports, updates, and site assessments, and any required or appropriate remediation or abatement, as well as compliance with all applicable environmental laws, will be the responsibility of the Respondent. Respondents must rely on their own independent research and conclusions for all development, financing, construction and operating costs. STATEMENT OF LIMITATIONS The Government represents that this RFI, submissions from Respondents to this RFI and any relationship between the Government and Respondents arising from or connected or related to this RFI, are subject to the specific limitations and representations expressed below, as well as the terms and conditions contained elsewhere in this RFI. By submitting a response to this RFI and without the need for any further documentation, the Respondents acknowledge and agree to the Government s rights and all other terms and conditions as set forth in the RFI, including the Statement of Limitations. The Government reserves the right, in its sole discretion, without liability, to use any or all of the RFI responses in its planning efforts and to develop and operate the Properties, in whole or in part, outside of the RFI process. The Government reserves the right to retain all the materials and information, and the ideas and suggestions therein, submitted in response to this RFI. All such material, information, ideas, and suggestions will become the property of the Government. This RFI does not create an obligation on the part of the Government to enter into any agreement, nor to implement any of the actions contemplated herein, nor to serve as the basis for any claim whatsoever for reimbursement of any costs associated with the preparation of responses submitted to the RFI. The submission of an RFI response is not required to participate in any potential future redevelopment process, nor does submission of a response preclude Respondents from participating in any future redevelopment of the Property. To the best of the Government s knowledge, the information provided herein is accurate. However, the Government makes no representations or warranties whatsoever with respect to this RFI or the Property, including representations and warranties as to the accuracy of any information or assumptions contained in this RFI or otherwise furnished to Respondents by the Government, site and environmental conditions on the Properties or the suitability of a Property, or any portion thereof, for any specific uses or development. Respondents should undertake appropriate investigation in preparation of submitting a response. A site inspection can be coordinated to give all Respondents the opportunity to examine existing conditions. This RFI is issued solely for information and planning purposes and does not constitute a solicitation. A response to this notice is not an offer and cannot be accepted by the Government to form a binding contract. The Government may request clarifications with any or all of the Respondents on an individual or group basis. Submission of a response does not guarantee the opportunity to participate in such dialogues. No claims for brokers fees will be paid by the Government. Respondents submitting business information pursuant to this RFI should consult 41 C.F.R. part 105-60 and other implementing regulations concerning the release of such information to third parties under the Freedom of Information Act. All information submitted by Respondents that they consider confidential and not releasable to third parties outside of the Government, and its employees, agents, consultants, and representatives, must be clearly and conspicuously so marked. ADDITIONAL INFORMATION The Government may schedule a pre-submittal briefing and tour of any or all of the projects listed in Appendix A for interested parties. To request a briefing and tour of a specific project, interested parties may submit an email request to RPSU@va.gov. If the Government schedules a briefing and tour, interested parties will coordinate with the interested party, to schedule the available day and time. Project Inquiries Questions regarding this RFI must be submitted by email sent to RPSU@va.gov. Written questions must include the Respondent s name, e-mail address, and the Respondent represented. Respondents also may ask questions during the pre-submittal briefing if a briefing is scheduled. Regarding questions not received in a timely manner, the Government will decide, based on the amount of research needed to answer the question, whether an answer can be provided before the RFI due date. SUBMISSION OF RESPONSES All interested parties should electronically submit a cover sheet, company description, and the attached completed questionnaire with appropriate supporting information clearly marked Response to RFI VA CHIP IN Act, Location/Project Name by 5:00 p.m. Eastern Time on April 20, 2017 to RPSU@va.gov. REQUEST FOR INFORMATION QUESTIONNAIRE Taking into consideration the projects identified in Appendix A), provide background and describe the envisioned donation project that would occur between you and VA; the type of entity that would be providing the donation; the proposed agreement structure; the key terms and conditions of the arrangement; the proposed timeframe to effectuate the transaction; any qualifiers or perceived hurdles regarding the proposed donation. Innovation is encouraged. Elaborate on why the proposed donation would be optimal as compared to an alternative. Explain whether renovation of existing buildings or new construction would be preferable and why. Describe your general financing strategy for the construction/renovation in light of the envisioned transaction structure. Identify any concerns or risks with the possible transaction structures that would affect your potential interest in the Property. What information would you need about the proposed donation to prepare your response to this RFI? Appendix A CHIP-IN Eligible Projects Primary Care and Mental Health Primary Care promotes team based, patient-centered care focusing on a personalized, integrated, comprehensive, and coordinated approach to health care. Primary Care actively partners with other VHA offices to develop and evaluate innovative programs that integrate VHA resources into the Patient Aligned Care Team (PACT) model. VA integrates mental health staff into each PACT, allowing the care team to provide services for depression, anxiety, PTSD, and substance use without needing a separate consult with mental health providers outside of the PACT clinic area. Veterans may stay for a short time or, in rare instances, for the rest of their life. VA provides facilities where Veterans can receive long-term recovery care, mental health treatment and geriatric care. In a Community Living Center(CLC) VA provides up to nursing home level of care, which includes help with activities of daily living (e.g., bathing and getting dressed) and skilled nursing and medical care. Unlike many nursing homes in the past, a CLC resembles "home" as much as possible. There are activities for Veterans of all ages. There are family friendly places for visiting. Veterans are invited to decorate their rooms. And, pets are allowed to visit or live in the Community Living Center. Below are Inpatient and Long-Term Care facility needs which are eligible to for donation through the CHIP-IN Act. VA Research is unique because of its focus on health issues that affect Veterans. It is part of an integrated health care system with a state-of-the-art electronic health record and has come to be viewed as a model for superior bench-to-bedside research. The research process in VA starts with a tight focus on the everyday health needs and concerns of Veterans, and with consultation with national and regional VA clinical leaders. Solutions are identified and developed through careful, rigorous research in labs and clinics, and sometimes in the community. These solutions are then applied to patient care, or translated into new or improved programs, as rapidly as possible. VA Research fosters dynamic collaborations with its university partners, other federal agencies, nonprofit organizations, and private industry thus furthering the program's impact on the health of Veterans and the nation.
