- 4 Modifications and Questions/Answers for RFQ 36C25618Q0268 Courier Transport Services, Jackson, MS Modifications: 1. Correct Statement of Work #13 Subcontractor information (page 20 of the RFQ) from: Subcontractors: All subcontractors used in performance of this contract shall be clearly identified by the Contractor. The Contractor agrees and certifies that minimally 51% percent of the cost of performance will be for work performed by employees of the prime contractor. Breach of this term by the Contractor shall result in termination by the Government. All requirements for submitting permits, licenses and insurance certificates and past performance data shall also apply to subcontractors. To be in accordance with 52.219-14(c)(1): (c) By submission of an offer and execution of a contract, the Offeror/Contractor agrees that in performance of the contract in the case of a contract for (1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern. The 51% does not refer to labor but ownership to be considered an SDVOSB which is found in 852.219-10(a) (1)(i) & 852.219-10 (1)(ii): (i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.201 Surviving Spouse definition); (ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran. 2. Correcting 52.222-42, Statement of Equivalent Rates for Federal Hires (MAY 2014) (page 29 of the RFQ), From: Employee Class from GS-05 Motor Vehicle Operator $16.00/hr, To: Driver/Courier, WG-5, Step 1, $15.85/hr + Fringe Benefits. Questions: Is there a current incumbent and if so who? There is not an incumbent. If there is a current incumbent how much was the total previous contract value? Not applicable. How long is the phase in period once the contract is awarded? The contract is anticipated to be awarded on or about Feb. 1, 2018 and will go through Sep. 30, 2018, four additional option periods beginning Oct. 1, 2018. Who is the current vendor and what is the old contract number? There is not an incumbent; not applicable. Is the requested service after-hours (2:00 p.m. through 7:00 a.m. weekdays) and on weekends (24 hours) part of the 150 trips per month? Yes; however, 150 trips per month is an estimate. It may be more or less. On the FBO page, you're asking offeror s to provide information on how they are going to provide over 51% of the cost of labor on this project. However, the updated CFR 125.6 states that " In the case of a contract for services (except construction), it will not pay more than 50% of the amount paid by the government to it to firms that are not similarly situated. Any work that a similarly situated subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded." The CFR is referring to the total cost of the contract, and not the labor cost. Any explanation is appreciated. Please refer to modification #1. above for detailed explanation. What is the previous contract number? Not applicable; there is not an incumbent. Is there a contract history available? Not applicable. Who is the current incumbent? None. Refer to questions 1., 4., and 7. above. Can the start date be moved to a later date? No, the contract needs to be in place Feb. 1, 2018. Can we recruit the current incumbent s employees? Not applicable; there is not an incumbent. Refer to questions1., 4., 7., and 9. above. Questions (Cont d) Is the current vehicle fleet available for purchase or does the government require new vehicles? There is not a current vehicle. The vehicle must be provided by the vendor at the vendor s expense. What was the cost of the final full option year of the previous contract? Not applicable; there is not an incumbent contract. How many drivers/vehicles are currently used to service the current contract? Not applicable; there is not an incumbent contract. What are the vehicle sizes required? The Statement of Work suggests a half-ton panel van, or car trunk, as required. The vehicle will need to be large enough to transport STAT laboratory specimens primarily, as well as, patient records, forms, and periodic transport of small amounts of laboratory supplies. CLINS 0001 and 0002 specify service between only GVSMVAMC and MS Baptist Health Systems, and GVSMVAMC and the University of MS Medical Center, but the SOW states, 4. Performance Requirement shall be as follows: a) As Needed Trips between GVSMVAMC and other medical centers and facilities throughout the Jackson Metropolitan area. Are pickups/deliveries required from/to locations other than GVSMVAMC, MS Baptist Health Systems, and the University of MS Medical Center? Not at this time. If so, to which locations/addresses, and how many trips per month are needed for each additional location? Not applicable. The SOW reads, Services shall be provided daily as needed as described below between the hours of 8:30 a.m. and 4:30 p.m., but also, Requested services are needed because the GVSMVAMC lacks the staff and transportation required to perform this type of service after-hours (2:00 p.m. through 7:00 a.m. weekdays) and on weekends (24 hours). Will after-hours service be needed? After-hours services may be required. If so, what is the monthly estimate for after-hours trips vs. business hours trips? The 150 trips per month is an estimate only. After-hours services to be included with the 150 trips per month. Please confirm 150 trips as the correct monthly trip estimate for the 3 locations listed in CLINS 0001 and 0002. The 150 trips per month are an estimate only. Trips may occur more or less per month. Questions (Cont d) Will this contract be SCA enforced? After reviewing the solicitation on FBO, it contains language and dollar values regarding the Service Contract Act. This solicitation stipulates $12.75 minimum wage for courier drivers, $4.27 minimum H&W, Sick Time/Vacation. Do you verify now that those are the minimum required rates to be performed on this contract upon award? Yes. I may or may not verify this, but I reserve the right to check it. The vendor must pay the employee the minimum required rates. A new SBA Final Rule regarding FAR Clause 52.219-14 Limitations on Subcontracting, dated June 30, 2016, reclassifies Independent Contractor drivers as Subcontractors 13 CFR 125.6 Work performed by an independent contractor shall be considered a subcontract. Please inform us how the VA would like us to proceed upon award regarding this rule change given that it will affect our offer regarding pricing and performance. Please refer to modification #1. above for detailed explanation.
