Description
The Overseas Private Investment Corporation (OPIC) is the U.S. Government's Development Finance Institution. OPIC's mission is to provide loans, guaranties, political risk insurance, and investment funds to assist American businesses expand into emerging markets. This is a notice issued as required by FAR 5.203. Because this procurement will be for commercial services and have a not-to-exceed value of below the $7,000,000, OPIC intends to award this sole source contract under the authority of FAR 13.501(a)(1). OPIC requires legal counsel to provide legal advice and representation in administrative matters related to OPIC's programs. Such matters may include, but are not limited to, administrative complaints, investigations, alternative dispute resolution, and proceedings and/or appeals brought before the Equal Employment Opportunity Commission, the Merit Systems Protection Board, and federal district and appeals courts. (Please note that federal court actions are coordinated with the relevant Assistant U.S. Attorney). These matters may involve claims brought under certain federal statutes including, but are not limited to: Title VII of the Civil Rights Act of 1964, the Whistleblowers Protection Act, and/or the Civil Service Reform Act. In order to perform this work, a law firm must have existing knowledge of and experience with OPIC's OPIC-AFGE Collective Bargaining Agreement as well as any ongoing administrative matters in order to prevent OPIC from incurring substantial costs bringing a new firm up to speed, as well as to avoid increased risk of unsuccessful resolution of some of these matters. In addition, a law firm must be able to commit to being completely unconflicted at award and remaining so for the full potential five-year duration of the contract. The law firm also must directly employ the attorneys who will perform the work. OPIC is not willing to accept the potential future conflict risk posed by pass-through subcontracting or legal staffing arrangements. The North American Industry Classification System (NAICS) code for this requirement is 541110 with the size standard of $11 million. This notice of intent is not a request for proposals or quotes; however, all responsible and capable sources may submit statements of capabilities, which, if received within seven calendar days of publication of this notice, shall be considered by OPIC. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
