- Notice of Intent The Office of Acquisition and Agreement Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the NIST Laboratories, intends to negotiate on a sole-source basis with Thermo Electron North America of Wisconsin, USA, under the authority of FAR Part 13.106-1(b), as implemented by the Federal Acquisition Regulation (FAR) Part 13 for the procurement of Polarization modulation infrared reflection absorption spectroscopy and Polarization modulation vibrational circular dichroism (PMIRRAS/PM-VCD). The Acquisition Management Division (AMD) at NIST intends to procure the required tristimulus colorimeters under a Firm Fixed Price Purchase Order using Simplified Acquisition Procedures for Commercial Items (FAR Parts 12 and 13). The NIST Physical Measurement Laboratory (PML) has a need for a PMIRRAS/PM-VCD for existing Nicolet 8700 FTIR spectrometer (NIST property #630743) and IS50 FTIR spectrometer (NIST property #N105140) to provide submonolayer resolution and enable dynamic characterization in wet environments such as monitoring battery electrode changes in an electrochemical cell. Only Thermo Electron North America PMIRRAS/PM-VCD is 100 percent compatible with respect to the current Nicolet 8700 FTIR spectrometer (NIST property #630743) and IS50 FTIR spectrometer (NIST property #N105140). To provide submonolayer resolution and enable dynamic characterization in wet environments such as monitoring battery electrode changes in an electrochemical cell a PM-IRRAS/FT-VCD is required and need to be compatible with the existing FTIR spectrometers, which use proprietary information. The PM-IRRAS/FT-VCD module consists of an external optics platform that relies on the source, optics, electronics, and software of the existing FTIR. On the external optics platform of the PM-IRRAS/FT-VCD Module are optics, a polarization modulator, sample stage, and external detector. In addition to using the source of the existing spectrometer, the new dynamic polarization, detector, and data processing are controlled by the existing FTIR software and hardware. For functionality and compatibility requirements, and to ensure the submonolayer resolution and enable dynamic characterization in wet environments, the new PMIRRAS/PM-VCD must be obtained from Thermo Electron North America. Only Thermo Electron North America has the unique capabilities of providing the identical type of PMIRRAS/PM-VCD as required to ensure full compatibility and functionality for providing submonolayer resolution and enable dynamic characterization in wet environments such as monitoring battery electrode changes in an electrochemical cell. Thermo Electron North America is the sole source provider for the required system and is the only vendor able to provide the PMIRRAS/PM-VCD that meet the Government's minimum requirements which makes them uniquely qualified. The North American Industry Classification System (NAICS) code for this acquisition 334516, with a size standard of 1,000 employees. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by February 23, 2018 at 11:59 pm Eastern Standard Time (EST) will be considered by the Government.
