Description: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. Solicitation number W31P4Q-18-Q-0031 is issued as a request for quotation (RFQ). The Government reserves the right to award without discussions. The solicitation document and incorporated provisions and clauses are in effect through the Federal Acquisition Circular 2005-80. The requirement is not a set aside. The associated NAICS code is 334515. The small business size standard is 1,000 employees. This is sole source to Tel Instruments due to proprietary rights to the software, also the kits and sets would likely be damaged if moved from the contractor's facility. Description of the requirement is as follows: 1. Solicitation number W31P4Q-18-Q-0031 is issued as a request for a Firm Fixed Price quote to upgrade to Windows 10 for the following software programs - Bench Utility and Field Maintenance, used in conjunction with the TS-4530A Radar Test Set. The contractor shall furnish a Software Publishers Certificate, acquiring a valid digital signature from Certification Authority (CA), adjustments to programming, testing of the software, product documentation, installer suite, configuration documentation, and provide source code for both programs to be placed in Army escrow. The US Army Contracting Command, Redstone Arsenal, intends to issue a firm fixed price contract to the original equipment manufacturer Tel Instruments. The statutory authority allowing for a solicitation to a single source for this requirement is 10 U.S.C. 2304 (g)(1)(A); Soliciting from a single source and no other supplies or services will satisfy agency requirement. The Government intends to use the policies and procedures of FAR Part 12 in conjunction with those at FAR Part 15 for this effort. The contractor shall deliver to the Product Director - Test Measurement and Diagnostic Equipment (PD-TMDE) the software upgrades for the Bench Utility and Field Maintenance, compatible with Windows 10 on CD-ROM discs. Additionally the contractor shall furnish a copy of the configuration documentation and source code also on CD-ROM discs. PD-TMDE will test both the Bench Utility and Field Maintenance software on a representative Windows 10 computer before final acceptance. 2. Storage The contractor shall provide storage for a 2-year period from the time of award for the completed TS-4530A Sets and Kits. The quantities to be stored are 280 Sets and 400 Kits. 3. GFE To aid in this effort PD-TMDE agrees to provide as Government Furnished Equipment (GFE) three Army computers loaded with the Army Gold Master copy of Windows 10, to be used during the development phase of the project. PD-TMDE also agrees to provide configuration information on what Windows 10 security features are enabled in Windows 10. PD-TMDE will submit the programs to the Certificate of Net Worthiness (CoN) process. PD-TMDE will also supply a Point of Contact (POC) for an Army Subject Matter Expert (SME) on Army Information Technology (IT), for consultation with the contractor. 4. The place of inspection and acceptance is Destination. FOB is at Destination. The shipping address is as follows: (Standard commercial packaging and shipping is sufficient for this requirement) Delivery DODAAC: W507J8 PEO, CS & CSS, PD-TMDE Army TACMS Road, Bldg. 3651 Redstone Arsenal, AL 35898-5000 The requiring activity requests the delivery of the Windows 10 upgrade no later than (NLT) 120 days after contract award. Earlier delivery is desired if at no additional cost to the government. Provision at 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition and any addenda to the provision also apply. Provision at 52.212-2, Evaluation - Commercial Items, is applicable. The lowest price technically acceptable is the sole evaluation factor. Non cost factors are of equal importance to price. Offerors shall include a completed copy of the provision 52.212-3, Offeror Representations and Certifications - Commercial Items. Clause 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition and any addenda to the provision also apply. Clause at 52.212-5 Contract Terms and Conditions - Required to Implement Statutes or Executive Orders - Commercial Items, also applies to this acquisition and additional FAR clauses may be cited as needed. Terms and conditions for this requirement are consistent with customary commercial practices. Contract financing is not authorized. Payment shall be made through Wide Area Work Flow (WAWF), in Accordance with DFARS 252.232-7006. DFARS 252.232-7003 - Electronic Submission of Payment Requests and Receiving Reports and Instructions. Payment method shall be through Wide Area Work Flow. DFARS 252.232-7006 - Wide Area Work Flow Payment Instructions. Oral Communications are not acceptable in response to this notice.
