- Amendment issued to 1) revise the applicable NAICS code and 2) address questions from prospective vendors. 1) The applicable NAICS code will change from 212321 with size standard of 500 employees to NAICS code 327999 with size standard of 500 employees. 2) Questions from prospective vendors: Question 1: Is the basis of award low price, price or trade off? Answer 1: The basis of award is not low price, price, or trade off. Basis for Award: The Government intends to award a firm fixed price, requirements contract resulting from this solicitation to the offeror who represents the best value to the government. Offers will be evaluated for acceptability but not ranked using the non-cost/price factors. Offers will be evaluated on the factors set forth below. Price. Technical Acceptability. Past Performance To state this more concisely and in plainer language, Award will be made to the offeror whom, after being evaluated by the evaluation factors provided, offers the proposal most advantageous to the Government amongst all proposals received. As referenced in the solicitation, FAR 13.106-2 Evaluation of quotations or offers provides the process to be followed for evaluation of offers received in response to this solicitation. Question 2: This is a commercial item why are you not using 52.212-2? Answer 2: As prescribed in FAR 12.301(c), When the use of evaluation factors is appropriate, the contracting officer may (1) Insert the provision at 52.212, Evaluation Commercial Items, in solicitations for commercial items (see 12.602); or (2) Include a similar provision containing all evaluation factors required by 13.106, subpart 14.2 or subpart 15.3, as an addendum (see 12.302(d)). Question 3: When we provide the VA supplies, pen, medicine, printing paper, does the Contractor provides a percentage for the supplier? Answer 3: Yes. See 2nd paragraph under Technical Acceptability evaluation factor: Identify any subcontractor(s) to be used in performance of this contract, along with the subcontractor s socio-economic status (e.g. Disabled/Veteran owned, Woman owned, Small, Large Business, etc.). If using a subcontractor, list the type and percent of work each party will perform. Question 4: Please define which best value process you will be utilizing? Answer 4: Evaluation Process: Quotes will be evaluated in accordance with FAR 13.106-2(b) Evaluation of Quotations or Offers. A best value process is not being used. The process followed in this solicitation is FAR 13.106-2(b) Evaluation of Quotations or Offers. Question 5: How will you evaluate the product? Does a write up evaluate a tangible product? Answer 5: Technical Acceptability. Each offeror s technical package will be evaluated to determine if the offeror provides a products or products compliant with the product description and delivery time found in Attachment A. -Technical Package for Evaluation The following shall be included as part of the offeror s submission: ·Product Description offered in response to the solicitation Question 6: Your requisition is a commercial supply product and it is a procurement from a non-manufacture of such supplies. Please address, 52.219-14(2) Limitations on subcontracting? Answer 6: FAR 52.219-14 is not applicable to this procurement and was not included in this solicitation. Subcontracting limitations are governed by VAAR 852.219-10 VA Notice of Total Service-Disabled Veteran-Owned Small Business Set-Aside (Jul 2016) (Deviation) and FAR 19.102(f). More specifically, 852.219-10(e) Any service-disabled Veteran-owned small business concern (non-manufacturer) must meet the requirements in FAR 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program. 19.102(f) Any concern submitting a bid or offer in its own name, other than on a construction or service contract, that proposes to furnish an end product it did not manufacture (a nonmanufacturer ), is a small business if it has no more than 500 employees, and (1) Except as provided in paragraphs (f)(4) through (f)(7) of this section, in the case of Government acquisitions set-aside for small businesses, furnishes in the performance of the contract, the product of a small business manufacturer or producer. Question 7: Is it allowed for my business to subcontract the work to another local company that is involved in that type of landscaping business? Answer 7: Yes. See Answer 6.
