- This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." The U.S. Army Corps of Engineers (USACE), Far East District (POF) intends to negotiate/award a sole-source firm-fixed price modification to contract W912UM-15-C-0011 with APEC Co., Ltd., Inc. (APEC Co., Ltd., CAGE: 3K10F). The primary work is for the contractor shall provide technical support for hazardous waste management services (HWMS) to include 1) management and operation of the hazardous waste storage area, 2) update hazardous waste management plan, 3) hazardous waste management training, and 4) participation of on-call spill response activities for Kunsan Air Base and Osan Air Base, Korea. The statutory authority for this non-competitive acquisition is10 U.S.C. 2304(d)(1)(B) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii). Under this authority only the original contractor is deemed the responsible source and no other supplies or services will satisfy agency requirements for follow-on contracts for the continued provision of highly specialized services to the DoD when it is likely that award to any other source would result in substantial duplication of cost to the Government that would not be recovered through competition and/or would result in unacceptable delays in fulfilling the Government's requirements. The contract was awarded to APEC Co., Ltd. on 13 March 2015 under contract W912UM-15-C-0011 to provide hazardous waste management support services, Osan AB and Kunsan AB, Korea. The subject bridge modification would extend the contract an additional two months extension in order to avoid a lapse in service while the follow on contract is finalized before July 2018. This action is a bridge effort to avoid a lapse in essential services and resultant unacceptable delays to the Government in the provision of those services until the follow on contract is awarded, estimated for July 2018. Due to the nature of these services, a lapse of coverage could result in delays in these services which have the foreseeable, unacceptable result of increasing the risks to life, health, and safety in the event of a spill of hazardous material. In order to respond to a spill without the bridge contract in place, the Government must hire a contractor's technician(s), obtain base access for the restricted area(s), obtain access for the contractor to Government internet systems, and otherwise facilitate access to spill accident area. At present it takes the Government more than three months to process a new contractor for approval to access a restricted area. As a result, failure to extend the existing contract's PoP until new contract is awarded could result in Government compliance failure and substantial physical damage to the environment including human health caused by pollution, contamination and explosion due to uncontrolled hazardous waste management. It is not feasible to find a contractor who can provide DoD experienced technical personnel and supporting heavy equipment in Korea with limited resources. Due to the time constraint. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 541990, all other professional, scientific, and technical services. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement, proposal, or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 11:00 A.M. local time on 16 May 2018, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
