- The Federal Bureau of Investigation (FBI) intends to award a sole source purchase order to BAE Systems, 10920 Technology Place, San Diego, CA 92127 for the following products and service: -IT Hardware XTS600 Trusted Guard (QTY 3) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-88, the North American Industry Classification System (NAICS) is 511210 with a business size standard of 6.5 million dollars. A quote is being requested under solicitation no. DJF-18-2000-PR-0006225 using Simplified Acquisition procedures. This will be a fixed price contract for a base year. Based on FBI market research, it has been determined that BAE Systems is the only source to meet the FBI requirement and no other supplies or services will satisfy the agency requirements. BAE Systems is the exclusive worldwide developer and distributor of BAE Systems Datagate Diode Suite, XTS Guard Suite, STOP License Suite, Maintenance and support (M &S), and the product training. Therefore, these commercial off the shelf products can only be purchased from BAE System and there are currently no U.S. distributors. The proposed contract action is for customization of hardware for which the Government intends to solicit and negotiate with only one source under the authority of TLE 41,usc (c)(1). This notice is not a request for competitive proposals. Interested parties may identify their interest and capability to respond by submitting a proposal to include technical qualifications and experience/pricing and any other information to Kayla Moore, Contracting Specialist, and address listed above. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1, Instructions to offeror-Commercial Items (JAN 2017): FAR clause 52.212-2, Evaluation Commercial Item (OCT 2014), FAR clause 52.212-4 Contract Terms and Conditions Items (JAN 2017); FAR 52.212-5 clause, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items (JAN 2017). Each offeror shall include a complete copy of the clause 52.212-3 Offeror Representations and Certifications - Commercial Item (JAN 2017). A determination by the Government not to compete this proposed required is based upon responses to this notice and is solely within the discretion of the Government.
