Please read Gray Market Item Clause below. When submitting a response to the sources sought, please include a letter on Manufacturer s letterhead confirming that you are a reseller or distributor of the items quoting on. Interested SDVOSB shall provide name of company, Duns Number, Point of contract, Email address, and telephone number. Once the information is submitted; the Contracting Officer shall verify that the interested party is a certified SDVOSB in www.vetbiz.gov and firm s registration in www.SAM.gov. Please be advised that this is not a solicitation. The North American Industry Classification System Code (NAICS): 339113 Surgical Appliance and Supplies Manufacturing, Small Business Size: 1000 Employees. All information shall be submitted, no later than 11:00 a.m. (local time), August 3, 2018, to Maria Cruz-Thompson, Contracting Officer, email: maria.cruz-thompson@va.gov. ITEM NUMBER DESCRIPTION OF SUPPLIES/SERVICES QTY UNIT 0001 Custom Tabletop Ultrasonic STOCK NUMBER: MISSWP 1.00 EA 0002 Stainless steel instrument tray STOCK NUMBER: MISSWP 1.00 EA Delivery of equipment to: VA San Diego Healthcare System, 3350 La Jolla Village Drive, San Diego, CA 92161 Gray Market Items (a) Gray market items are Original Equipment Manufacturer s (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers.   No remanufactures or gray market items will be acceptable.   (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM.   All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract.   Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
