VHAPM Part 808.405-6 Limiting Sources Page 2 of 2 Original Date: 08/30/2017 Revision 01 Eff Date: 04/23/2018 DEPARTMENT OF VETERANS AFFAIRS FAR 8 Justification for Limiting Sources (LSJ) For Limiting Sources (<SAT) Acquisition Plan Action ID: VA262-18-AP-9343/664-18-3-5471-0027 Contracting Activity: Department of Veterans Affairs, VISN 22 San Diego VA Healthcare System NCO 22, 664-18-3-5471-0027 Description of Action: This requirement is for the purchase of Trimble Geo Manager GPS Vehicle Tracking Hardware and associated Fleet Management Software Services. The hardware and software services will be utilized to provide real-time, web-based monitoring of the VA vehicles. This is a follow-on order to Order against: FSS Contract Number: GS-07F-5588P /VA262-16-F-7452 Name of Proposed Contractor: Trimble Engineering Street Address: 935 Stewart Drive City, State, Zip: Sunnyvale CA 94085 Phone: 408-456-6649 Description of Supplies or Services: The estimated value of the proposed action is $ 37,795.60 The GPS hardware and software services must be compatible with the current VA San Diego GPS fleet management software service and reporting capabilities. The Trimble GPS hardware, and Trimble s GeoManager GPS Fleet Management software services are currently installed on 87 fleet Vehicles and were purchase in accordance with FAR Part 804 Federal Supply Schedules. Authority: ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception: An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A); Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B)); In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)). Rational/explanation to support cited authority: This is an additional purchase for VASDHS. Trimble GPS fleet management software was purchased 09/22/2016 VA262-16-F-7452. 87 units were purchased and installed Purchasing GPS hardware that is not compatible with Trimble GPS Fleet Management Software Services will create inconsistency in reporting of data, management of GPS equipment and a training deficiency with personnel. In addition, this will create additional costs for the Government to procure a new GPS Fleet Management system that would not be compatible with the current VA San Diego GPS Fleet Management hardware and software service. This should be a sole source award to Trimble Engineering IAW FAR 13.106 and 8.405-6 (C) Limiting Sources, based on the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
