- The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with Thermo Electron North America, 5225 Verona Road Bldg 1, Madison, WI 53711-4497. The sole source justification is based on the following: The National Institute of Standards and Technology (NIST) requires a full-service contract for its Thermo Fisher Scientific Neptune Multi-Collector Inductively Coupled Plasma Mass Spectrometer (MC ICP-MS, SIN 01062 N). The maintenance of this mass spectrometer at the highest level of operability is a high priority requirement because of NIST's high profile in international Key comparison of Si isotopic measurements in support of the redefinition of the kilogram as well as for the certification of isotopic reference materials. Thermo Fisher Scientific is the sole equipment manufacturer and service provider for all Thermo Fisher Scientific instruments, parts, training, technical support, field service support, and software. Thermo Fisher Scientific owns proprietary rights to the design and software utilized in this instrument They are the only company with access to performance verified component parts, spare parts, software, technical support, upgrades and engineering resources to maintain the original operating specifications. Their Field Service Engineers are the only certified and factory trained engineers available to service the instrument, and are part of an organization that is ISO certified. There are no third-party providers of these services. Previous contracts for these services have been awarded to this contractor on a sole source basis. The contractor has provided an updated letter reaffirming this situation. Thermo Fisher Scientific is a large business providing the required maintenance services for Thermo Fisher Scientific Neptune Multi-Collector Inductively Coupled Plasma Mass Spectrometer (MC ICP-MS, S/N 01062 N) Neptune and they the only source available to provide the required services. The NAICS Code is 334516 with a size standard of 1,000. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by 9:00 am ET August 20, 2018, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
