- Control No: JA-18-Hua-630 FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items Sole Source Justification and Approval 1. Contracting Activity: Army Contracting Command-Aberdeen Proving Ground, Huachuca Division, 2133 Cushing Street, Fort Huachuca, AZ. 85613 2. Description of Action: The 114th Signal Battalion requests to procure a standard option pager maintenance service plan from the sole source (brand name) provider SPOK Incorporated, in support of the Raven Rock Mountain Complex, PA. The anticipated types of funds are Fiscal Year (FY) 18 Operations and Maintenance (OMA). This resultant order will be Firm-Fixed Price. 3. Description of Supplies/Services: The 114th Signal Battalion requires maintenance support for its messenger paging system at Raven Rock Mountain Complex. The 114th Signal Battalion requires the "Standard" option support plan, which provides 24X7X365 telephonic access to SPOK technical personnel for questions and assistance. The plan also allows access to SPOK online knowledge base, Customer Community, and product upgrade notifications. The period of support is one (1) year from award, with one (1) option period. Support is currently expired and requires reinstatement. 4. Authority Cited: This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) 13.501(a)(1)(ii), Only One Responsible Source and no other supplies or services will satisfy agency requirement, brand name description. 5. Reason for Authority Cited: The order will be issued on a sole source basis because SPOK Inc., is the only company that meets the government's requirements. Only SPOK Inc., can provide the services because the support required is only offered by SPOK Inc., which owns all proprietary data and licenses required to perform maintenance updates to the software required. 6. Actions to Increase Competition: Market research was conducted if any other company could provide hardware or software maintenance on the already existing hardware and software infrastructure. No other company has proprietary rights or certifications to the hardware or software already existing. A special notice as required by FAR 5.201, for a sole source contract was posted to the Federal Opportunities website (FedBizOpps) on 03 August 2018, and made available for public inspection and comment. The closing date for the synopsis is 07 August 2018. To date, no companies have expressed an interest in performing, or have provided comments for this effort. 7. Market Research: Raven Rock Mountain Complex Information Technology Services Switch Systems Division used competitive methods for their original purchase of the equipment in 2014, and a sole source procurement in 2015, 2016 and 2017. Since purchase of the hardware from SPOK Inc., no other vendor has been identified as an authorized maintenance provider for the equipment to be serviced. Other Facts: SPOK Incorporated has provided the government a letter asserting its sole source status for the equipment, software, and services for the AMCOM messenger paging software version 4.3.9. 9.
